Yes, but if you get judged to be too mentally retarded to be held accountable, you should be locked in a mental asylum forever.
This is why attempting an insanity plea is a very bad idea in most cases. They can commit you for a lot longer than the comparable sentence for the crime and there's no set end date.

If someone isn’t in the right state of mind to be held responsible, then they aren’t capable of said crime with criminal intent. However, it would be foolish beyond words to let a madman run free, so we place them in asylums for treatment.
Think of all the resources society spent on him only to get an individual you can go "well isnt committing any crimes".

The cope goes both ways on this: either it's too cruel and evil to execute some psychotic retard or thug, like locking them in a padded cell for decades with no purpose isn't senseless torment, or, akshually, keeping said retard or thug in a padded cell for decades is a worse and more fitting punishment than just executing them, as though there is any merit in keeping an irredeemable criminal alive for the sake of tormenting them.

I say split the difference. Guaranteed 0% recidivism rate and the offender is totally insensitive to earthly pain or pleasure for the small price of a yard or two of rope (injecting criminals like a pet dog is both undignified and cowardly, much as indefinite and prolonged imprisonment).
