The fact that you can't outright purchase a classic game is the real problem here. I would say it's intentionally this way, probably so when they bring their online service to the next console, you still need to pay the subscription to access the classic library.
Good point, though that didn’t stop them before. If you wanted Super Mario Bros. on your Wii, Wii U and 3DS, you had to buy it three times. The most they did was let you get the Wii U version at a discount if you transferred your Wii purchases, which was a one-way transfer that left your Wii empty.

Sony did that practice as well with PS2 titles on the PS3 and PS4. Let's use a R* game for instance, San Andreas. If you bought the PS2 Classic version on the PS3 but wanted it on PS4, you had to buy it again. Even though they were both running on an emulator, only difference was that PS2 titles for PS4 had trophy support.

Nah, Nintendo is pretty bad too. Out of the three in terms of politics they're the least worst, but the way they're treating the eShop shit where Sony is actually keeping their store up is the kind of shit Nintendo is known for. Basically, "Fuck you, buy this" is their mentality and always has been. They hate anyone even trying to archive the games or amiibos - which are even more limited - and keep them around. Not even Sony goes after those people like Nintendo does. I'm hesitant to say this, but I'll take political retardation over that level of greed.

Fact is, the big three are equally awful in their own ways. That said Microsoft seems to be making the biggest effort to offer legitimate access to old stuff now, but so is Sony. Shame they're both politically retarded because all the new stuff they offer is just bland and boring safe trash. Which I guess is why they're trying to offer a legitimate means to the old stuff. What we need is a new contender again. A fourth player if you will.
Nintendo has obviously its flaws, but I can tolerate them on the principle the main company is apolitical and doesn't involve itself directly with japanese 3rd-party development, like California SIE did. Piracy is forever but screwing with creative content publishing, out of political-correctness, is far more than a mere inconvenience by comparison. For creators and consumers alike.

Nintendo of America and Treehouse can both fuck off though, as they proved to hire the same type of individuals who hold contempt towards the JP culture.

Also Sony still did shutdown the PSP store, closed down the old desktop version of the PSN store (most likely to prevent the browser script exploit to extract download URLs of legitimate purchases and share them to others), and there are reports of games getting harder to download from the old PSN.

I believe that if a company shuts down a digital store, the contents within that store should be public domain for preservation reasons.

First, piracy is sharing. I mentioned the web browser exploit of the old desktop PSN store because that's how I shared all the content from my japanese PSN account to NoPayStation in 2019-2020 (which also required fake authentication keys generated by a plugin in my Vita). You exactly sound like the leechers who believe piracy make things magically appear out of thin air, since certain things (like Nintendo stuff) are much easier to find than others.

But most of all, moral grandstanding over piracy or buying is the most stupid internet argument. I decide whichever option is the most convenient personally, in a case-by-case basis. Piracy on Switch is not favorable for me (yet) for instance, while on the other hand, I wouldn't have any issues to buy ebooks off Amazon Japan if they weren't region-locking digital goods.

If the mere mention of piracy makes you lose any rational thinking and literacy skill, that's your problem. I don't see your attitude as anything different from a 'pirate' getting triggered by people buying stuff.

How does it mean nothing? It can be released whenever the rights holder feels like it. Preservation is important so that things that society as a whole might view as important don't get destroyed and can be released in the future if demand should ever arise. Any one individual having access to purchase something doesn't mean shit. For that, piracy exists, but not as preservation- call it something else.
 
Me? I have a much deeper hatred for the “fans” who own actual, possibly one-of-a-kind prototypes and refuse to dump them for everyone else to play because of the deranged mentality that their prototype will somehow lose its value if other people have access to the rom.

Marble Madness II. In the early 90s, Atari was going to release a sequel to Marble Madness, subtitled Marble Man, due to one of the powerups being that you could transform into a muscular version of your marble. Also the marbles talked, for some reason. It was practically finished, and test cabinets were shipped out, but Atari cancelled at the last minute due to said tests not going very well. Even though ROMs of the game were out there, the various asshole collectors who had them wouldn't dump them because of what @Two Dollars said. It wasn't until an absolute Chad by the name of dank2079 dumped it almost a year ago, and another Chad MAME developer, David Haywood, converted it into MAME that people at large could finally play it. Also, don't know when else I'll be able to say it, so here it is: no matter your thoughts on the gameplay, the soundtrack for Marble Madness II actually slaps, and for that reason alone, I'm glad it was finally found. Here are my favorites:
