At least according to the article, it still has to be under certain circumstances, like lolicon with sex that doesn't have any "serious literary, artistic, political, or scientific value."
I could see Akemi becoming the next Handley.
Akemi has said on his Facebook page the lolicon artists that he likes, one being an artist that routinely draws old guys breaking into little girls houses and violently raping them. Show that to a jury and say it's just art and see what they say. And he physically owns copies of said material, not like he just viewed it on the internet - he wanted to support the creators because he loved the material.
