It's been a while but I figured I would give you all an update. The following is what was learned from the file.
1. The motion to suppress is done, it is 25 pages long. My lawyer says she is going to have to condense it down.
2. The search warrant according to the guys in Washington DC and my lawyer is that the warrant was BAD really Bad.
3. The police didn’t have probable cause. Their “probable cause” was based only on one tip that was given to the FBI. In fact, is the police got my IP address from my ISP on March 19, then got the warrant for the computers on March 21st. Then got the IP and information from the website the threat was posted on, on March 31st. They should have got my IP address from my ISP, and well as the IP and information from the website the threat was posted on to verify and collaborate that my IP and computers posted the threat. There was NOTHING to link my computers or my IP to the threat. Therefore, they had no probable cause. The police didn’t do that because they were looking at a “plain view” reading of the threat meaning it was threat, that was name, therefor under a “plain view” reading you did it. That’s why didn’t investigate.
4. The affidavit for the search warrant wasn’t lied on, but the officer did leave a lot of things out. Like in the warrant he stated I was arrested many times before for making threats including in 2015. He left out the fact that the charges were dismissed, and he could easily check to see if the charge was dismissed or not. If the judge knew that fact. That the charges had been dropped he probably wouldn’t get the warrant. He also only mentioned the FBI receiving the one complaint and left out that there was no investigation done prior to asking for the search warrant, including as stated above they could have got my IP information and the information from the website to see if there was a link between my IP and the threat but didn’t. He also left out what his qualifications were and what type of investigation was done, which we know there was none. The fact he had only been an officer for 1 year prior to getting the search warrant showed he had little experience if writing one.
5. The warrant was and is a general warrant. The warrant allows the seizing of the devices but doesn’t specify what they are supposed to look for. Search warrants are supposed to have particularities, this one only seized the device, allowing them the seize all information on the device, which they aren’t supposed to do. When writing a search warrant for digital devices they must limit what they are searching for with a file or file type and the scope with a time frame. With this warrant they were allowed to rummage through millions of documents and files that had nothing to do with the threat. There was also no time limit in the warrant. The particularities of the warrant also must be limited in time frame. For example, the threat was made on March 16th, 2018, therefore the time limit maybe March 1st to March 17th, 2018, allowing them to search only between those dates, limiting the scope of the search. The fact that the IP address was not on the threat, they had no reason to search the devices to begin with. This wasn’t one computer by the way, this was four computers, three external Hard Drives, 4 jump drives, 1 DVD and 1 CD. With particularities that would have limited what they are allowed to search for, this warrant did not, so they were allowed to search and seize anything that they deemed to be a crime.

They waited 2 years to get it making it unreasonable and 2. the officer seeking the warrant told the federal judge that they had Daugherty’s computers to investigate a threat against a school, but what he left out was that there was no link between the threat and Daugherty’s computers and the charges by the state had been dropped. If the federal judge knew that fact, he wouldn’t have issued the warrant. 3. If the federal judge would have known that the state warrant was a general warrant, then he also wouldn’t have issued it.

Are you really fucking retarded...When someone make threat online you need to verify that they posted it through an IP address. Nope our expert stated it was general warrant (which I knew) they are experts in fourth amendment law so, yeah. As for the second warrant, he didn't mention that the original charges were dismissed, the federal judge was unaware that the charges were dismissed, and the FBI was very much aware that the charges were dismissed.

I suggest you read United States v Winn (2015 US District Court, Southern District of Illinois) maybe that can help you out.
The lawyer was waiting on our experts (NACDL Fourth amendment center) but it is done and will give it in July. The lawyer says the state might just drop it because it is REALLY BAD it is a clusterfuck. What I recently posted is some of the breakdown of what they said, there is some I've probable left out, but the warrant was "BAD"

The website was called Hate and Flame, and someone posted a threat against a school on that site under my name. that's what this shit, and the image they found came from the warrant for that shooting threat, a warrant that was a general warrant.
As for the NACDL I wouldn't know but here a wiki page on then. This a federal case it's a state of Illinois case.
