Wrong, I've been on the HF a number of times. Do you know how many frequencies there are on the amateur HF bands? Because apparently you don't. Just because I'm not on the frequencies, YOU and your friends cause chaos on doesn't mean I'm not on the ham bands. The only thing that was "removed" was my antenna because we torn down our garage, I'm planning to put it back up as soon as the weather gets nice, right now it's been raining. As for flying, they didn't stop me, I can still fly. They did stop me buying a trike from Australia because they are still a little new to buying stuff online especially over seas. I, on the other hand buy stuff from all the seas all the time, including China. It's cheaper to buy stuff over seas then it is here in the US.

One finally thing, as for those warning letters from the FCC; Riley Hollingsworth doesn't know shit when it comes to Part 15. According to him the field strength on 13.556 was suppose to be 30 uV (microvolts) per meter at 3 meters, when it's actually 15,848 uV per meter at a distance of 30 meters. For those on here, that more then what a walkie - talkie on 49 MHz, put out. 49 MHz. walkie - talkies put out 10,000 uV per meters at 3 meters (or 1/4 of watt) Finally Riley was going after me for posting my name as Todd O'Dochartaigh on the internet. Tell me when did the FCC begin regulating the internet and tell people how they should post their name, because if that the case then this site is in violation of the FCC policies. The fact is the FCC does not regulate the internet and Riley Hollingsworth of the FCC exceeded his authority.

Incorrect. From FCC §97.113:

(a) No amateur station shall transmit:
...
(4) Music using a phone emission except as specifically provided elsewhere in this section; communications intended to facilitate a criminal act; messages encoded for the purpose of obscuring their meaning, except as otherwise provided herein; obscene or indecent words or language; or false or deceptive messages, signals or identification.

The FCC has taken enforcement actions against hams violating this policy.
 
The FCC has fined people, but if it was to go court it probably be thrown out; simply put the FCC rules regarding 97.113 has never been challenged. The rules are overbroad and would pass the "constitutional muster" 97.113 states amateurs aren't allowed to broadcast, however under 97.111(b)(6) states

"(b) In addition to one-way transmissions specifically authorized elsewhere in this part, an amateur station may transmit the following types of one-way communications:

(6) Transmissions necessary to disseminate information bulletins.

an information bulletin is define in Part 97.3(a)(26)

"(26) Information bulletin. A message directed only to amateur operators consisting solely of subject matter of direct interest to the amateur service."

So what I was doing on the ham bands with my bulletin was legal. The difference between a information bulletin and a broadcast is a information bulletin is directed to hams, while a broadcast is directed to the general public.

Free Speech does apply to radio, including ham radio. Hams have more free speech then broadcasters, simply because they (broadcaster) have limited band space while hams have a lot more space, and that's due to the part that broadcast stations are coordinated to a frequency, while hams aren't. broadcasts have to run 24/7 a day 365 days a year, hams do not. So our free speech is greater then theirs

Obscenity is not protected speech, the FCC does have the ability to restrict obscene and indecent material on radio frequencies and this has all been upheld by the courts, even if the exact definitions of obscenity and indecency are vague. Just because the specific clause of Part 97 hasn't been adjudicated on doesn't mean it's not a priori valid. I would argue that amateur radio deserves as much regulation, if not even more so than broadcast radio, for the following reasons:
  • The FCC does not require a license to receive transmissions on the amateur radio bands. Unlicensed people, including minors, can and do monitor the ham bands.
  • There is no minimum age requirement to receive an amateur radio operator license. Minors can and do get licensed and transmit on ham bands.
  • The HF bands can propagate worldwide, and with interlinked networks like IRLP, Allstar, Echolink, and the various digital radio networks, even VHF+ have potentially worldwide reach. For the simple reason of maintaining international goodwill, which is expressly stated as a purpose for the amateur radio service, the FCC has an interest in limiting obscenity.
  • Allowing obscene and indecent communication does not fit with the purpose of the amateur radio service, and even inhibits it. Why would you get a ticket or encourage others to get one if the bands are filled with basement-dwelling manchildren calling everyone cunts and faggots? I would also like to point out the sales of scanner and Shortwave radio receivers has actually gone down in years, in fact Shortwave broadcasters themselves has seen their listenership gone down and lot and Shortwave broadcast radio is hurting thinks to FM / satellite and internet broadcasting. Secondly minors only make 1% of the amateur / listener viewership so claiming minors can listen doesn't hold water. for a minor to listen they have to have a radio to receive those frequencies like a scanner and Shortwave radio and again as I stated above sales for those has gone down over the years. The courts have actually point out the fact that minors only make up 1%. so again that claim doesn't hold water.

You have no basis for your assertion that only hardcore porn meets the Miller test. Even if your rants might not meet the Miller test, they are still patently indecent and offensive to the average person and I am confident that if an enforcement action was taken against you for them, and you challenged it, the action would be upheld. That's not even taking into consideration the purpose of the amateur radio service which any court is also going to consider.

The mere fact that there is no license requirement to Rx and that minors do get licenses means that the standards for the content of transmissions on amateur bands are going to be held to a stronger standard of decency than late-night HBO programs. There is no expectation of privacy on ham bands. Anyone is free to listen to any ham band frequency at any time. You can't even encrypt your transmissions except in very limited circumstances. If I eavesdropped on a cordless phone frequency and I overheard two people having phone sex and I reported them to the FCC for indecency, they'd just laugh at me. And if I did that with a cell phone conversation I'd go to jail.

I will quote in full FCC §97.1, which defines the basis and purpose of the amateur radio service:

The rules and regulations in this part are designed to provide an amateur radio service having a fundamental purpose as expressed in the following principles:

Hams have more free speech then broadcasters, simply because they (broadcaster) have limited band space while hams have a lot more space, and that's due to the part that broadcast stations are coordinated to a frequency, while hams aren't. broadcasts have to run 24/7 a day 365 days a year, hams do not.
