Alan entered a plea of not guilty, he will appear before a court and the court gave the defense 10 days to file their motions. Furthermore, Alan demanded a jury trial and his defense counsel requested a copy of the Indictment of his arrest.

Alan's defense attorney made a request for evidence that is favorable to him.

The most likely explanation is that the case isn't airtight for one reason or another. The federal conviction rate at trial is like 99%, and they're known to only take slam dunk cases and leave everything else to the state courts. Especially given the high profile nature of this case, that's the only reason I can think of as to why they would give it to Florida.

The only hard evidence tying him to torswats seems to be the residential IP leaking through Tox, but I'm not sure if that can be admitted in court as evidence since it's not from a LE source. Everything else is circumstantial. The feds found Alan's discord through Jackie Singh tier reasoning and concluded it belonged to torswats, but it's also plausible someone he knew from foodist circles was impersonating him on telegram by using LOTR usernames and saying stuff like "I swatted myself" and "someone reported me to the FBI" as Alan was being swatted or reported to the FBI. Him being edgy, googling Wayne Lambright or watching swatting videos isn't surprising if he was in the same circles documented in this thread. I dont think him using the same VPN as torswats is particularly persuasive either since Mullvad is widely recognized as one of the best privacy-oriented VPNs.
As long as he retains decent legal representation I think there is a non-zero chance he may be found not guilty on all counts.
