An Ohio man was arrested Tuesday for raping a 10-year-old girl who became a central figure in the debate over abortion rights after she reportedly traveled to Indiana to have an abortion when Ohio outlawed the procedure last month.

Arrest records and court records viewed by The Daily Beast confirm that Gerson Fuentes, 27, was arrested Tuesday in Franklin County on a felony charge of raping a person under 13. The Columbus Dispatch, who first reported on his arrest, attended Fuentes’ arraignment in Columbus on Wednesday.

The unidentified girl’s plight became national news when the Indianapolis Star quoted a doctor who said a 10-year-old rape victim, who was six weeks and three days pregnant, had been forced to travel from her home in Columbus to Indiana for an abortion. Her home state had a trigger law that immediately outlawed abortions after six weeks once the Supreme Court overturned Roe v. Wade.

A Columbus Police detective, identified by the Dispatch as Jeffrey Huhn, testified in court Wednesday that the 10-year-old victim was impregnated and had an abortion in Indianapolis.


“The victim went out of state to have a medically terminated abortion,” he said, according to video of the arraignment.

The video showed Fuentes staring blankly during the arraignment and standing with a slouch as a translator relayed the proceedings to him in Spanish.

Court records say the alleged rape occurred on May 12. Detectives said in court that police were made aware of the girl’s pregnancy through a referral filed with the local child services’ branch by her mother on June 22. Eight days later, the girl had the abortion in Indianapolis.

The aborted fetus has since been tested for DNA and entered into evidence, Huhn said, and officials say Fuentes confessed to the rape when he was questioned.

Fuentes’ arrest comes as conservative media claimed the girl’s story was made up for political theater, something parroted by Fox News presenters as recently as Tuesday night—while Fuentes was already in custody.

But those also with egg on their face in light of the horrific crime: the top law-enforcement official in Ohio.

Indeed, state Attorney General Dave Yost spent much of the past week effectively dubbing the story a hoax, suggesting he had heard nothing about any such crime being reported.

“We have a decentralized law enforcement system in Ohio, but we have regular contact with prosecutors and local police and sheriffs,” Yost said in a Fox News segment Monday. “Not a whisper anywhere.”


Yost released a statement Wednesday afternoon that did not address his previous comments.

“My heart aches for the pain suffered by this young child,” he said. “I am grateful for the diligent work of the Columbus Police Department in securing a confession and getting a rapist off the street.”

Dr. Caitlin Bernard, the Indianapolis obstetrician-gynecologist who first described the rape and its aftermath to the Indy Star, previously told The Daily Beast she expected vindication.

“It will all come out in time,” she said via text message on Tuesday.


Court records show Fuentes is being held on a bond of $2 million. The judge said he was considered a flight risk and, given the brutality of the crime, a high bail was necessary to protect the child involved.

The little girl is extremely likely to die in event of giving birth too. That's common as hell knowledge, even with modern medical science.

I knew someone who was raped (this was back when women didn't make shit like this up for internet attention and the asshole that did it went to prison for it) and has said that even if she had gotten pregnant from it she wouldn't have gotten an abortion because she didn't think it was the babies fault. Granted she was in college when this happened and not a 10 year old girl and a pretty hardcore Christian. Perhaps it's also much easier to say something like this when you aren't actually in the position, but there are likely a some people who actually do believe this.

I'd personally like to believe that the people out there who are claiming that they want to get pregnant just so they can have an abortion are just being edgy and making up hyperbolic shit just to get a rise out of others, but it seems pretty clear that there are a few of them who really do believe what they say. It's not particularly surprising that a few people who are on the other extreme of the opinion scale to exist that aren't just talking big. Most people just don't live that far out on the edges or even pretend to exist there so the notion of their existence seems beyond reason.

That, I can buy. My grandfather was a product of rape. Of course, they were in beanerland so abortions were a no no and not exactly mainstream at the time. It's one thing for it to be you and one for it to be another person, much less a ten year-old girl.
 
Outside the political theater and awfulness of the crime: Why is a 10 year old girl ovulating with the ability of getting impregnated by rape? This isn't nature's design and hasn't been throughout our evolution. How/why/what is fast tracking girls into the womenhood realm while still being child?

I'll gladly admit that I thought the story was made up and I still refuse to trust the lugenpresse because they refused to show their work when they ran the story.

Good for Ohio getting a rapist off the street. Gold star.

Of course, all of this might have been avoided, the abortion and the rape, if Senor Fuentes had not been able to illegally migrate from Guatemala to the United States, thanks to our big, beautiful wall.

Anyone who was incredibly skeptical of this story had every right to be, and this right here is why. A lot of people had to make some incredibly stupid, sometimes illegal decisions for a situations like this to arise.
  • The doctor never reported the crime despite it being illegal not to
  • The family never reported the crime
  • The girl wasn't given emergency contraceptives after the rape
  • The family waited exactly six weeks to seek an abortion
  • They never even had to leave the state to begin with because it wasn't fucking illegal in the first place
There are so many plot holes here the fact that it's real makes it a one in a billion comedy of errors. And honestly, it being real is even more harmful to The Narrative, because it went from "we lied like we always do" to "we used a 10 year old rape victim as political ammunition even though her situation didn't actually apply". This is like a reverse Reddit Detectives vs. The Boston Marathon Bomber situation, and every bit as stupid.


From what I've read, about 10% of girls have had their first period by the age of 10. So it's uncommon, but really not that rare.
I wonder if the victim and her family are also illegal which would explain why the doctor apparently didn't report it and the family didn't go to the police. These loons would rather cover up a 10 year old's rape leaving him free to victimize other children than risk ICE getting involved.

You and me both. Hell, Yost thought the story was bullshit because the crime was never reported. That's fucked up. That girl's parents should be in cells for their negligence, and the doctor who examined the girl should be next in line for the firing squad after that Fuentes illegal. Also, the woman who performed the abortion because she's a psychotic ghoul who blew this up for attention.

Being pro-wall and pro-choice are not mutually exclusive concepts, but treating it as such while taking the pro-abortion angle implies you're pro-rape. Given he's an illegal immigrant, this situation was entirely preventable with greater border control, so using this as a rallying cry for abortion implies that preventing the rape doesn't matter, only dealing with the consequences of it. To such people, the crime itself is not the real problem. Preventing the illegal immigrant from crossing the border would have prevented the rape and there'd be no abortion discussion to be had. There'd be no need for an abortion if there were no rape which couldn't have happened if this alien were repelled at the border.

This situation conveniences both sides but one has a significant upper hand over the other. I support border control and the abortion.
 
An abortion won't give the kid justice; no, but pregnancy and childbirth are;(or at the very least can be) very difficult and traumatic things to deal with.
So is abortion.

The objective here is about doing the best that can be done to avoid her dying on account of a pregnancy she's hardly developed enough to bear.

I don't understand how some people want to use this tragic story for political points about what the supreme court did when it just seems that the problem here was with Ohio. If children don't have some kind of exemption in the law then clearly Ohio's abortion laws are just shitty. The people of Ohio need to get off their ass and make their state do something about it. Why do people gotta be lazy and try to make big sweeping laws to cover the whole country?
 
Not everyone this person thinks the baby should be adopted but I’m happy that the rapist is in jail.

The real tragedy is that he'll be in administrative segregation because of the nature of his crimes. One can hope they screw up and put him in Gen pop for a bit.

Absence of a father is correlated with earlier puberty. I don't see the words "father" or "parents" in the article.

Well the mandated reporters only worried about this getting reported and prosecuted when people were accusing it of being fake. The DA says the law had exceptions that would apply. So the message I'm getting from all this is: this case would have never said anything to anyone if they did not think it could be weaponized as a political tool.
