Isn't that past the statute of limitations? It's been a few years since we found out the guy was a cheater and his scores were unverified at best.

Not that it matters since he has no cause case because many of the guy's high scores are literally impossible to achieve given the programming of the game, therefore making Todd Rogers a liar and a cheater.

The Todd Rogers lawsuit (The Florida state court one) was filed right at the two year mark which I believe was that statue of limitations. It was filed January 29, 2020. The TG announcement of taking down Roger's records was exactly two years previous.
The Todd Rogers cases are dumb because he doesn't even have an attorney. He filed all the papers in the case himself and is representing himself. In addition to being a liar and a cheat, Todd Rogers is also extremely broke. He has no money
to speak of.

TODD ROGERS VS GUINNESS WORLD RECORDS LIMITED et al​


On 1/29/2020, Todd Rogers filed a defamation lawsuit against Guinness World Records Limited, Twin Galaxies LLC, Jason Hall and Spectrum Business Ventures in the fifth Circuit Courts - Hernando County, Florida.

Case 272020CA000093CAAXMX

Todd Rogers wrote the original complaint and initially represented himself in the case. He had no attorney. He paid $400 to file the lawsuit.

On 9/15/2020, Rogers hired an attorney named Peter Berkman to represent him in the case and make the whole thing slightly less stupid than it was.

He is a graduate of the University of Miami School of Law, 1981


The case then went to sleep for a long time due to COVID. It came back to life when an amended version of the complaint was filed by Rogers
on 4/2/2021. Notice was then issued to all the defendants. So far, Guinness World Records has been the only one to respond.

The lawsuit claims that the Todd Rogers suffered defamation. They further claim that the defamation led to Tortious Interference in his business
and economic interests.

Rogers claims to be in the business of making appearances at video game events for which he received compensation. He says he suffered financial loss
by not being invited to these events after the alleged defamation.

Rogers claims that the defamation was made in statements that claimed:
  • He had not earned certain scores
  • He falsified certain scores

Todd Rogers claimed he suffered losses over 1 million dollars. He seeks damages of not less than $500,000.

He claims that Guinness defamed him through a statement in the 2019 World’s records gamers edition:

“….In Jan. 2018, our partners at Twin Galaxies (TG) confirmed that his time was not technically possible and he was stripped of the record – though Rogers still insisted it was a legitimate time.”

He claimed that Twin Galaxies defamed him through the article Twin Galaxies' Dragster Dispute Concludes with the Banning of Todd Rogers

Todd Rogers address is listed as 8027 Baltic St, Brooksville, FL 34613. Its a mobile home.

There isn't really any more than that to say at the moment. The complaint in the case is seven pages long and doesn't provide much more detail than
I have given here. He doesn't describe his income, his losses or give any detailed support as to how much money he was making before he ran into trouble.

I believe he was actually looking at a statute of limitations issue and couldn't immediately hire a lawyer, so filed it pro se to save the case from dying because of a deadline, and subsequently retained counsel. This isn't optimal but it wouldn't be particularly stupid under the circumstances.

No it's a decently big brained move, actually. But aren't some of his claimed scores agreed to be literally impossible by everyone who isn't just blatantly on team Todd? He must have come up with some way to put down a pretty hefty retainer to take on a boarderline frivelous case.

Twin Galaxies made the decision based on a "lack of evidence" argument rather than just arguing they were physically impossible.

"We cannot change Activision's acknowledgement of this score but we have an overall responsibility for gaming achievements and can no longer accept their historical records as the sole justification for scores set at the time. We were not there, can not find any of the evidentiary materials they used at the time to confirm the score, and could not find anyone who would on-the-record testify that they directly saw the evidence that was presented to Activision."

The dragster score is, at a technical level, impossible. But only people with a certain level of technical knowledge understand why its impossible. Judges and juries are usually made up of people without that knowledge. And those people will often not be easily convinced of something like "impossibility". People in the legal system will often make decisions emotionally. There was the same problem within the arguments over the dragster score on the Twin Galaxies forums. There were people who "got" why it was impossible. But there were alot of other people who didn't get it and thought there must be some end-run around the "impossibility" that had not been considered. People often react psychologically to an argument of "impossibility" as if it were a challenge. to them to find a "loophole"

In court, I would expect the Twin Galaxies argument to be that they invalidated the scores based on lack of evidence. That they didn't defame Todd or call him a cheat. That they just said that with all the information, there wasn't enough evidence to validate the scores. Its far easier to make that argument than to try to convince people in court that something is physically impossible.

The case isn't really going to be seen as "frivelous" by the legal system because the legal system will not understand the technical issues. And I think his problem with getting an attorney would be in terms of having the money to pay one rather than concerns about how the case looked.

But IMO, he is wasting his time and money with the case. Twin Galaxies and Guinness were really careful about what they said with regard to his records and their whole process of dealing with the score disputes. He would also have a tough time proving damages.
I realize that strange things happen in the legal system and nothing is ever guaranteed in terms of results, but in IMO everything is against Todd Rogers in this case.

I think the flaw in your analysis is that 12 random Florida men have no emotional connection to Todd Rogers. In fact they will be kicked off the jury if they do. A lot of people on the forum don't want to find out a guy they liked/looked up to/whatever cheated.

I never said sanctions were likely, but lawyers dont generally like problem cases. If you did any research at all before you let Todd Rogers sign you up, it'd be an obvious problem case and that's going to get built into the fee. Even if it doesn't stick it's pretty obvious to me that a major defense/counter attack is likely to be "Todd is a lying liar who lies, all his scores are fake and gay, and now he showing fake stuff to the court". That shit is a pain in the ass to defend against even though it has a low chance of working, and if you do loose on that issue the chances of a bar complaint or malpractice suit from somebody like Todd are astronomical because it's how he keeps the cope going.

Karl Jobst just released a video claiming that Bully Mitchell's case was getting dismissed.

And that Bully cried at the end of the meeting when one of his case against Twin Galaxy got dismissed (alledgedly)

Billy's pro se lawsuit against Twin Galaxies in Florida was dismissed without prejudice due to a lack of prosecution. He was ordered to show cause after 10 months of inactivity and didn't. His lawsuit against Twin Galaxies in California (with actual lawyers) is still ongoing. This isn't really a loss for Billy. As Karl said, the lawsuit in Florida was kind of a backup in case things didn't go his way in California. He never did anything with it. He might even consider it a win with Karl claiming he won't be discussing Billy anymore. That's what he wanted all along. Karl must be too busy defending Dream for cheating in Minecraft speed runs these days.

For those distressed at the decreasing number of Billy Mitchell lawsuits, worry not! He filed suit against his former friend and Pac-Man world record holder, David Race, in April 2021 for recording their phone call where he talked about his scheme to discredit Twin Galaxies. David had been on Team Billy, but switched sides when an old MTV recording was uncovered that proved Billy was lying to him.

An update on

TODD ROGERS VS GUINNESS WORLD RECORDS LIMITED et al​


On 7/30/2021, an order was filed for Todd Rogers to respond within 10 days to a motion. He did not. The case was closed on 8/9/2021. The case was dismissed without prejudice. Todd Rogers Attorney withdrew from the case on 8/20?21. My assumption is that the case was ended because Todd Rogers failed to respond to the motion to dismiss filed by one the defendants (The guiness records people) on 6/30/2021.

The notice of the attorney withdrawing was interesting. He gave as grounds that continuing to represent Todd Rogers would create an unreasonable financial burden on himself (the attorney) that would impact the sort of representation he could give Todd Rogers. Reading between the lines, I would assume that Todd didn't have any money to pay an attorney with.

Todd Rogers appears to be back to representing himself. He filed a motion yesterday with the court to vacate the dismissal. If he were to overcome the dismissal, he would be back in the position of having to respond to the motion to dismiss by one of the defendants.

The judge, on the 9th, reopened the case. Unfortunately for the fuckwit, Todd Rogers, it is only for the sole purpose of resolving the motion to withdraw filed by the attorney. It appears that the judge isn't really too interested in hearing out Rogers, and is prepared to dismiss with prejudice once the attorney's motion is resolved. It was a bench order, thus no document was generated.

A shrew of documents was filed on the docket on behalf of David Race. They will be attached below. There is an MTD due to lack of personal jurisdiction, and then a couple of answers to Billy boy's discovery, but no formal answer to the complaint. The MTD will be documents 6 and 6.1, and the answers will be documents 7 and 8.
