When you say "recruiter companies," do you mean HR software vendors like Workday? Or job search sites like Linkedin/Indeed/etc.? Or something else?
When you go to a companies webpage and click on "jobs" it will usually take you to a listings page and you click on the position you want. That will take you off to a different site where you actually upload your resume/cover letter/details. Apparently, these applications don't just go straight to the employer, but according to my friend, are instead "curated". According to him, they are starting to use race as a factor in this for "equity". The system is opt-out rather than opt-in, so the employer has to explicitly go in and say "no I don't want diversity". If it works like everything else these days, it's not going to hide your resume from the employer per-se, but the employer will log in and it will go " ❤️ here's your top 10 picks for today! ❤️" and white job seekers are less likely to be on that list.

For his company, he says that this system is not fully implemented yet and the roll-out is slow. However, I've learned that all these companies are roughly in sync with their actions. If one is doing it, that means others are too and possibly already started earlier this year.

Now, TO BE FAIR with this, I described to him my specific situation and he said that sounds too extreme even for this system and he thinks it's likely that I'm triggering some kind of spam filter by accident. Unless the AI is just wildly incompetent, I don't see how that could be.

James Damore might (might) have scored a nice settlement from Google, but he's not working anymore and I doubt the settlement was enough that he's set for life.

I know California has horrific laws that actually make hiring based on race legal correct? In fact I believe it's enforced. Could they be using that to 'export' this result to the rest of the country?

Sure, if you can get it. Damore went after the deepest pockets around and now he's just sitting around in his mom's basement playing Magic The Gathering, as far as I can tell. I think a lot of people would prefer working for a living and making a software developer's salary, if the alternative is never working but eating Kraft Macaroni and Cheese off of paper plates the rest of your life.

Not everybody will have as clear cut a case as Damore had, though, especially when it comes to why you weren't hired in the first place. The burden of proof would be on you to prove that the only reason you weren't hired was because of your race, and not because you don't have enough experience in a certain tech or whatever other completely valid reason not to hire someone they might have. Technically it's also illegal in many places for a criminal record to also be a reason not to hire anyone, but it's effectively impossible to enforce that for the same reason.

"But that's illegal!" doesn't stop 90% of drivers from speeding, or 70% of high school students from drinking or smoking pot, or 95% of Silicon Valley companies from using race as a basis for hiring. (Numbers pulled from my ass but they're probably close.)

With large corporations, you're dead on the money.

With smaller and mid-sized boutique tech companies like @Rusty Crab mentioned, the mere presence of a lawsuit might be enough to scare them or get them to settle.

No they didn't, they settled. I doubt it was for free or even nuisance value. Even minor bad publicity for a company like Google means tens or hundreds of millions of dollars lost. What stops the companies from flagging something like "degree from BYU" as "undesirable" and getting away with it? We all know that's basically code for "white people" without saying "white people", what stops them from flagging various things like that without actually looking at race and gender?

Why can't they do that on purpose and exclude white male coded words and organizations, like my BYU example? Or just resumes that are worded more "masculine"?

I've interacted with some of these headhunter/recruiter companies and anecdotally they are absolutely stocked with young white women and therefore are likely into woke bullshit to some degree, so I can believe what @Rusty Crab is saying.

Nothing, so long as you were very careful never explicitly to say that, just like nothing keeps you from chucking a resume from Evergreen straight into the trash. There are places, like ironically enough California, where employers can't retaliate for off-work political activity, but outside of those, you could even just explicitly refuse to hire any Republicans, or Democrats. If they could prove by direct evidence or inference this was coded racial discrimination, or discrimination against sex (or gender identity in places with that), ore religious or national origin discrimination, or any other class protected by local law, you could be in trouble.
