Naming and shaming IS illegal in China. At the very least your post will be shadowbanned off social media. Worst you will be arrested for "inciting public disorder" and thrown in jail for an indeterminate time of "Administrative detention" and then sentenced.

I just finished watching Yardfish's video on this subject and hard disagree here. The cat abusers in China are mind boggling retarded. Several have been doxed (quite swiftly as well), only to discover they have family that are high-ranking members of their local community or government, who leverage their power to get it swept under the rug.

What's the most baffling is that a lot of these abusers will openly shit-talk China, the CCP, even fucking Xi Jinping. One shithead even larps as a Japanese soldier during the Rape of Nanking, like what in the actual holy mother of fuck.

Yeah, but his parents are card members under a clique that is probably a major faction so nobody gives a shit. There's a saying in China 党在法外 or "(The Communist) Party is outside the law". Being in the CPC will protect you from offenses that would otherwise get you in trouble. In order to get these folks in jail, you either need to pull rank on him (and have enough rank to not get fucked by their patron's patron's patron), or you need to cause enough of a stir so they can't ignore it (easier said than done).

Don't believe for a second they can't fuck you up either. These folks will literally murder you to keep their jobs. This is because in China, any public servant, whose immediate family is accused of a crime cannot serve in a government job for two generations. There's a third method to get these people but do you really want to deal with the MSS (Chinese glows) or the army?

Everybody shitalks Xi, most just aren't dumb enough to do it in public.

A: Not really. This depends, if the animal belongs to another person and if it is worth a lot, then this act is illegal under the pretense of "property damaging". Typically, 1-7 years imprisonment.
A2: So unless someone tortures and kills a pure blood prize pet, or an endangered animal, there's no outright law to punish them with.
A3: If the act led to social unrest, civil unrest etc, then it will be considered major.
A4: Basically, it's legal to adopt, torture and kill your own pets.

Q: What are the other provisions?
A: It is illegal to torture and/or kill most wild animals.

但是,《反虐待动物法》呼吁多年迟迟没有出台。那么,其立法难点究竟在哪?我们又该如何保障动物不受侵害?记者就此采访了相关专家。
现有法律法规虽较分散,但暴力虐待行为仍可处罚
虐待动物事件近年来时有发生,尤其是很多人通过网络传播虐待动物的视频博人眼球,甚至形成黑色产业链。此类行为层出不穷的原因是什么?中国人民大学法学院教授周珂告诉本报记者,我国法律对动物实行分级分类保护,现有法律体系偏向于对野生动物的保护,对伤害保护范围之外的其他动物,法律的约束功能相对较弱。因此,此类虐待行为更多的是从舆论和道德的层面进行限制和谴责。
我国目前与动物保护相关的法律现状如何?中南财经政法大学教授钱叶芳告诉记者:“每次发现有虐待动物的行为,几乎都会出现全民谴责,然后呼吁出台法律。这种心情可以理解,但必须强调,这很容易给大众,尤其是虐待动物的群体一种‘我们国家没有保护动物的法律’的错觉,让虐待动物群体更加肆无忌惮。实际上我国早有保护动物的法律法规,对暴力虐待动物、传播虐待动物的暴力信息明确为违法行为,并且有法可依、可处罚。”
据钱叶芳介绍,我国《野生动物保护法》《畜牧法》《实验动物管理条例》《动物防疫法》等各类法规,以及《网络表演经营活动管理办法》《邮政法实施细则》等相关条文都对动物虐待行为进行了否定,并或轻或重明确了法律责任。
同时,虐待动物扰乱社会治安、传播虐待动物暴力信息的行为,均可依据《治安管理处罚法》《未成年人保护法》《网络安全法》等相关条文予以禁止。
“可以看到,目前我国现有动物保护法律法规对线下虐待、线上传播行为,不仅进行了否定评价,还基本建立了相应的法律责任体系。”钱叶芳表示,只是目前动物保护法律法规比较分散,或有残缺,没有形成完整的体系,法律责任也不够严明。
伴侣动物保护管理存在空白,缺乏适用所有动物保护的一般法
据统计,这几年被爆出的虐待动物案例中,猫狗这类动物被虐待的频率最高。2020年,农业农村部将猫、狗这类动物从《国家畜禽遗传资源目录》中剔除,并将其定义为伴侣动物。国际爱护动物基金会认为,将猫和狗称呼为人类伴侣动物,意在突出它们在人类社会中的作用。
纵观我国现有的动物保护法,畜禽动物、野生动物、实验动物等都制定了专门法律,唯独猫狗类伴侣动物没有,这也使得对它们的保护和管理存在空白区域。
钱叶芳告诉记者,目前我国缺乏一部适用于所有动物的《反虐待动物法》,或者《动物保护法》。而在一些国家和地区,保护所有动物的动物保护一般法加上各分类立法,就是一套完整的体系。目前,我国在这方面还比较欠缺。
周珂认为,我国动物福利立法体系之所以没有完备建立,与我国大多将动物作为自然资源以及财产来保护的立法目的有关联。“动物作为资源实际上更多的是被利用,这会导致动物福利保障打折扣。而从目前全球立法目的发展趋势来看,这种立法实践越来越少,取而代之的是基于环境伦理对动物加以保护,即以动物福利为立法目的,这也是目前各国动物保护立法的趋势。”
对此,钱叶芳认为这和历史进程有直接联系。钱叶芳举例,在20世纪80年代,我国大力关注野生动物,一开始在某种程度上把野生动物作为资源来进行保护。后来,随着保护生物多样性、生态平衡等理念不断增强,于是法律也与时俱进,不断修改,保护色彩也变得浓厚。
而我国对于其他经济和政治属性不强的动物,比如伴侣动物,还在被商业利益裹挟,并且多年来处于放任的状态,于是产生了虐待猫狗等伴侣动物产业链。
钱叶芳表示,在立法层面,除了要将反虐待动物或者动物保护一般法提上议程,目前最可行的是补全分类法中的《伴侣动物保护和管理法》,因为社会生活中,虐待、虐杀的动物对象大多数是猫狗这类与人类朝夕相处的动物。
立法需达成社会共识,保护与管理并重
近期频上热搜的“虐猫”事件,让关于反虐待动物立法的呼声,再一次回到公众视野。但在国家级立法层面上,反虐待动物立法一直没有实质性进展。一个不可否认的事实是,反虐待动物立法,在现实中存在种种障碍,业内专家表示,究其原因主要是在很多立法问题上没有达成社会共识。
例如,保护和管理并重是动物保护立法的基本原则。但现实中,动物管理尚未引起足够重视,虽然新修订的《动物防疫法》将文明养犬和流浪动物管理要求上升到国家法层面,各地养犬管理立法均有实施,但是遛犬不牵绳等不文明养犬行为非常普遍,“犬伤人”“人伤犬”等人犬矛盾构成我国基层社区和乡村治理中的主要矛盾之一,人犬矛盾也大大削弱了动物保护立法的群众基础。
同时,“伴侣动物”如何界定、反虐待动物法中的动物范围具体应包括哪些、分类标准是什么、具体什么样的行为算“虐待”、虐待动物的严重程度如何界定……也有待达成社会共识。
此外,复杂的国情也为相关法律的出台带来了障碍。中国国土辽阔,以至于不同区域间有关动物保护的风俗习惯差别较明显,不能“一刀切”进行立法,如何在符合国情的同时妥善兼顾各地风俗,是立法必须解决的问题。
立法需要时间,那当下,如何能让更多人关注和重视动物福利与保护问题,减少对动物的伤害?
钱叶芳告诉记者,首先,要认识到现行法律法规可以对动物提供基本的保护,在专门立法出台前,执法部门要严格执法,并履行普法义务;其次,民政部门应当弘扬动物慈善文化,鼓励扶持动物保护和管理类的社会组织,并大力培育发展社区组织,发挥基层社区的自治优势;另外,社会各界应汇成一股动物保护的潮流,宣传普及动物保护理念。普通民众也应当从自身做起,去保护身边的动物,监督身边不文明对待动物的行为。
周珂也分享了他的想法。“在动物保护法律出台前,可以尝试用《民法》的一些规定,如类推适用、或准用,以期解决动物受虐待问题。”周珂举例道:“发布虐待动物的消息或者视频,会给动物保护爱心人士、广大公众尤其是少年儿童带来心理健康的损害,可以尝试借用《民法》中关于精神损害赔偿的内容和一些个别条款对此行为追究法律责任。同时,这种行为对社会公益也造成损害后果,可以尝试借助环境公益诉讼来追究其法律责任。”
“一些经济相对发达、社会文明发展较好的地方,针对目前法律有漏洞的区域也可以先进行地方性立法。”周珂表示,如果从地方推进反虐待动物相关立法,或许会更容易些,率先出台地方性法规,社会效果呈现出来之后,会对全国产生辐射带动作用。

2017年9月13日凌晨,上海警方在延安路高架上发现了一只受困的小猫,为了救它,警方临时封闭了这段高架路,并叫来消防员进行帮助。在双方的协作下,小猫最终被成功解救了下来。
So in 2017, Shanghai cops rescued a stranded cat on a high way, they blocked the high way to rescue the critter.

This is the first known viral animal torture case, which I personally followed back when I was working in China.

I could be totally wrong about this but I would say a good summation is the following:

It's very illegal to disrupt public order, to piss off groups of people (outside of government sanctioned protests against Japan, for example), but being provocative and angering people of a result of your provocative actions is illegal.

At the same time, there's no wrong way or reason to kill any wild animal.

So while killing or mistreating animals is legal, it can get you in legal trouble if it causes problems for others.

on October 16th, Yardfish, the guy who made the video featured at the top of the OP, had contacted me to talk about the cat torture people. I never screencapped his message, but I remember what it said, he described the cat torturers as being like 'the final boss of zoosadism', because unlike the monkey fuckers, the cat abusers in China are rather smart and have miles better opsec.

combine that with the massive language barrier anyone from the English speaking net would face when trying to investigate them (note, that monkey fuckers talk amongst themselves, and to their VOs in English, despite the VOs being Indonesian mainly), and it becomes an immensely tricky prospect.

as much as people in this thread have been slagging off the Chinese, at this moment the only people that have an entrenched ability to do anything about the cat torture, are Chinese activist groups. they have been doing work, but at the end of the day it's a tragedy whenever community activism has to struggle to fight against what should be the prerogative of the government.

I'm hopeful that they'll all see the inside of a slave mine in inner Mongolia, but it's not something that can happen overnight, and not without a lot of hard work, especially grassroots action

All posted by this instagram account. In early March, Mr. Fresh was rescued from the streets and placed in the home of a "guardian," a member of one of the cat advocacy groups in China trying to combat the torture ring.

Unfortunately he developed some heath problems about a week ago and is back at what looks like a temporary shelter run by Street Cat. The account claims that Street Cat refuses to release him back to the guardian. Fucked up if true, justice for Mr. Fresh.

A lot of these cat torturers love to larp as big, mean and strong men. Torturing animals makes them feel powerful.

Now living in Virginia, Qiu runs a pro-democracy YouTube channel and has faced an onslaught of homophobic, racist and bizarre insults from social media accounts that Linvill’s team and others have tied to Spamouflage.

Some accounts have posted cartoons that convey Qiu as an insect working on behalf of the US government. Another image depicts him being stomped by a cartoon Jesus. Yet another paints him as a dog on the leash of an American rat.

“I tell people the truth, so they want to do anything possible to insult me,” Qiu said.

Linvill and his team have tracked hundreds of these cartoons across the internet, and said they are a “tell” of Spamouflage. Cartoons, Linvill explained, can be more effective than text because they are “eye-catching” and “you have to stop and look at it.” In addition, these original cartoons can easily be translated into hundreds of languages at a very low cost.

Beyond the online smears, Qiu says he has also faced threats via other online messages and escalatory calls from unidentified sources who he believes have ties to the Chinese government. One anonymous message told him he would be arrested and brought to justice for breaking Chinese law. An email referenced the church he attends in Manassas, Virginia and said, “for his own safety and that of the worshippers, he would do well to find another place to stay.”

Qiu told CNN that the FBI has interviewed him four times regarding these threats, and that he has been instructed to contact local police if he is ever followed.

“Every day I live in a sense of fear,” Qiu said.

Let this be a warning to anyone investigating these sick fucks. Some people are using western moral outrage to smear critics of the CPC. This basically exemplifies disinformation, it takes several minutes to make up some shit and it took me an hour to discredit it.
