Even for failure to state a claim, the judge is typically going to dismiss with leave to amend. Dismissing with prejudice is reserved for cases where the court has considered the merits and finds nothing to justify allowing the plaintiff to amend and re-file it.

Oh I know. It's just I've never seen an analysis done like this in the same sorts of situations. They just always go for the easy jurisdiction and punt it, causing folks to have to go pay yet again when they get sued for the fourth time for the same meritless claims just worded different. When the solution would have been to dismiss with prejudice. Because those judges never award you fees because they did the jurisdiction bounce. It's a vicious circle and very wrong to do to innocent defendants. The perp always gets away without paying because they are pro se. What about the defendants? If Josh doesn't get fees Russell gets away scott free and that really pisses me off. A lot.
