It might not change the meaning of the facts, but it absolutely changes your argument. The facts are that your shit is on this site. If you're arguing that Josh "allows" it, then you have no case. If you're arguing that he's "inducing" it, then that's a different argument and you might have a point.
But even that doesn't seem to be the problem here. The issue is that the judge doesn't see any inducement, no matter what you want to call it. It's not a matter of you not using the correct magic word, you impenetrable autist.
