Actor Alec Baldwin discharged a "prop firearm" that killed a cinematographer and injured a the director of the movie Rust, being filmed on a set south of Santa Fe, a county sheriff's office spokesman said late Thursday.

Halyna Hutchins, 42 and the director of photography for the movie, died at University of New Mexico Hospital in Albuquerque. The film's director, Joel Souza, was hospitalized in Santa Fe, Santa Fe County Sheriff's Office spokesman Juan Ríos said.

A source closed to the investigation said Baldwin, 63, was questioned by investigators late Thursday and was seen by a New Mexican reporter and photographer in tears.

Investigators are still trying to determine if the incident was an accident, Ríos said. No charges have been filed, and the investigation remains open, Ríos wrote in a news release.

The prop was fired at Bonanza Creek Ranch, where filming was underway, the sheriff's office said in an early evening news release. Baldwin stars in the production.

Hutchins died from her injuries after she was flown to University of New Mexico Hospital, according to the sheriff's office. Souza was taken to Christus St. Vincent Regional Medical Center, where he is receiving emergency care, the sheriff's office said. Attempts to get comment from Baldwin were unsuccessful.

“We received the devastating news this evening, that one of our members, Halyna Hutchins, the Director of Photography on a production called ‘Rust’ in New Mexico died from injuries sustained on the set,” John Lindley, the president of the International Cinematographers Guild Local 600, and Rebecca Rhine, the executive director, said in a statement, as reported by Variety. “The details are unclear at this moment, but we are working to learn more, and we support a full investigation into this tragic event. This is a terrible loss, and we mourn the passing of a member of our Guild’s family.”

Deputies were investigating how the accident occurred and "what type of projectile was discharged," the sheriff's office said in an earlier news release.

Rust Movie Productions did not immediately respond to requests for comment.

Filming for Rust was set to continue into early November, according to a news release from the New Mexico Film Office. It's described as the story of a 13-year-old boy left to fend for himself and his younger brother following the death of their parents in 1880s Kansas, with New Mexico doubling for Kansas.

Guns firing blanks have been blamed for deaths in past movie productions. Online Hollywood news site Deadline reported, "Actor Jon-Erik Hexum was killed Oct. 18, 1984, on the set of the TV series Cover Up when he accidentally shot himself in the head with a gun loaded with blanks. And in 1993, Brandon Lee, the son of martial arts legend Bruce Lee, died after he was shot in the head by a gun firing blanks on the set of The Crow. Both incidents were determined to have been accidents."

That only applies if some criminal act of neglect occured that resulted in the death of somebody. A truly unforeseeable accident would not count as involuntary manslaughter.

Also, no charges have been filed yet. This is a clear accident, some investigation needs to happen before criminal negligence is considered.
In Texas, if you shoot and kill someone while cleaning a gun, that's manslaughter. Some gun range employee did that and as of 2018 was facing 2-20 years in prison though I can't find any further articles.

Since Baldwin was aiming at two people and hit both, even if he thought it was only a prop, he's almost certainly going to get charged by the State of New Mexico with manslaughter unless the DA fucks up. Better lawyer up for that and the inevitable lawsuits that will come up.
 
Is it possible that he fire the gun at something, then that something took the brunt of the blank and sent shrapnel towards pretty blond and director guy? She gets peppered to the jugular, he gets peppered to the chest or whatever?
 
A woman has died and a man has been injured after actor Alec Baldwin fired a prop gun on a New Mexico film set for the 19th Century western Rust.
Halyna Hutchins, 42, was shot while working on the set as director of photography. She was flown to hospital by helicopter but died of her injuries.
The man, 48-year-old director Joel Souza, was taken from the scene at Bonanza Creek Ranch by ambulance.
Police said they were investigating and that no charges had been filed.
A spokesman for Mr Baldwin, best known for his role as Jack Donaghy on the NBC sitcom 30 Rock and for his portrayal of Donald Trump on sketch show Saturday Night Live, said the incident involved the misfiring of a prop gun with blanks.

In a statement to AFP news agency, a Santa Fe sheriff spokesman said Mr Baldwin had spoken to detectives.

"He came in voluntarily and he left the building after he finished his interviews," the spokesman said.
Mr Baldwin is a co-producer of the film and plays its namesake, an outlaw whose 13-year-old grandson is convicted of manslaughter.
The eldest of four brothers, all actors, Mr Baldwin has starred in numerous TV and film roles since the 1980s.

Ms Hutchins was from Ukraine and grew up on a Soviet military base in the Arctic Circle, according to her personal website. She studied journalism in Kyiv, and film in Los Angeles, and was named a "rising star" by the American Cinematographer magazine in 2019.
She was the director of photography for the 2020 action film Archenemy, directed by Adam Egypt Mortimer.
"I'm so sad about losing Halyna. And so infuriated that this could happen on a set," Mr Mortimer said in a tweet.

In a statement, the International Cinematographer's Guild said Ms Hutchins' death was "devastating news" and "a terrible loss".
"The details are unclear at this moment, but we are working to learn more, and we support a full investigation into this tragic event," said guild president John Lindley and executive director Rebecca Rhine.

Police said sheriff's deputies were dispatched to Bonanza Creek Ranch, a popular filming location, at around 13:50 local time (19:50 GMT) after receiving an emergency call about a shooting on the set of Rust.

Incidents such as Thursday's fatal shooting on the Rust film set are extremely rare, but not unheard of.
Real firearms are often used in filming, and are loaded with blanks - cartridges that create a flash and a bang without discharging a projectile.

In 1993, Brandon Lee - the 28-year-old son of the late martial-arts star Bruce Lee - died on set after being accidentally shot with a prop gun while filming a death scene for the film The Crow.

It was later determined that the gun used had earlier fired a round that caused a cartridge to become lodged in the barrel. When blank rounds were later fired, the cartridge was dislodged and released.

Responding to Thursday's news, Brandon Lee's sister Shannon tweeted: "Our hearts go out to the family of Halyna Hutchins and to Joel Souza and all involved in the incident on 'Rust'. No-one should ever be killed by a gun on a film set. Period."

The accident that resulted in Brandon Lee's death didn't result in any criminal charges being made against anyone, just a civil lawsuit between Lee's family and the production company. Granted, the laws in North Carolina (where that accident happened) may be different from New Mexico's, but there's no guarantee that anyone will be dragged in front of a judge because of this, and if anyone does, there's no guarantee it'll be Baldwin specifically.
 
So either gross negligence by the armorer/crew (for not checking the weapon/making sure the shot was safe), or gross negligence by Baldwin for doing something he shouldn't have with it. I look forward to the inevitable fingerpointing as both sides try to avoid blame, because whoever is found responsible should be fucked.
I'm inclined to believe @kobebyarlant 's image mostly because Alec Baldwin is exactly the sort of short-tempered egotist to fuck around and have other people find out for him.
