Ofc Russhole may have accidentally suggested that his copyrighted intellectual property is indecent and/or obscene. It still wouldn't affect Null because Section 230, but it'd be the first time in his entire life that Russhole has shown even the tiniest skerrick of self-awareness (albeit subconsciously).
Well, his book is so stupid it's offensive to people with normal intelligence, but I don't think you could call it obscene.

If he really wanted to sink whatever chance at getting Null's response thrown out by pulling the "I know you are but what am I" card, he could've save a lot of trouble, time, and effort, if he simply stating "In response to Defendants statement that Plaintiff is relitigating, here is my reply:" And xeroxed this underneath.

Skimming what I can find... this is a really exceptional situation, I was trying to find ANY case-law concerning this type of motion and an expectation of actually responding in a timely manner. Thing is, as a Canuck Google doesn't really send me the best results for American law, let alone a specific state, even if I feed it some solid terms to limit the scope. I also lack the knowledge to quickly find the correct cases. From what I can find, it's very much up to the judge. While properly the time limit should apply, as the law is the law, this is a nonsensical filing and the response was a formality as well as a jab at his wallet, not to mention Null and and Skordas probably assumed this was done and over with.

If a legal kiwi could find any case law on this for the very specific case of replying to an 59(e) late being tolerable due to the exceptional nature of such a filing, I am going to go with the rule that the law is the law and you should file on time. Skordas is, in fact, in the wrong here.

It's a fun academic question, but in reality, it's just an excuse Russ will use to self-soothe when he fails again. If the judge exercises her discretion and accepts the filing, then she was clearly incompetent. And if she doesn't? Well. The dang bias judge should have taken the fact that they filed one document late as proof that they didn't care. This means so much to Russ, can't you see? And they don't even care! Aw, c'mon judge. Let him have his way.

The fact of his failure is inevitable either way. It's just which excuse he uses for why he failed that's yet to be seen.

No one here cares about Russhole outside of laughing at his chuckle-fuck failures, gawking at his Pipsqueak antics, and generally partaking in the exquisite Schadenfreude Russ provides us free of charge. If Russhole were to drop dead or disappear forever back to his home galaxy, no one would shed a tear or lose a wink of sleep over it. They'd lament the loss of lulz and go find some other clown shoes mongo to laugh at.

Look, people here say they don’t wish Russ dead but the fact is that if he was run over by a bus tomorrow the world would be a better place.

There’s nobody’s life wouldn’t be improved if that bus came along, including us who’d have to find something productive to do with that half an hour a day we otherwise spend laughing at him.
