Nah this judge was way too soft on Russell, saying the court sympathized with his "plight", then saying he may have had a case under the DMCA, and directing him towards the Court of Appeals. She isn't familiar with Russ as we are, but this will be taken by him as encouragement to go to Appeals. After all, a "good job" from a producer led him to believe he should be on AGT, and a like on a tweet led him to believe he should date Farrah Abraham. It doesn't take much for him to view it as affirmation.

I think I can see where the Judge was going with that statement, but as she said, she's the judge, not Russhole's advocate and attorney. But I'm sure he'll read in to it more than he should, which will end with hilarious results.

Also, on a completely unrelated note, if I wanted to create a statute book club or reading list to share with @Null and everyone here, I would recommend 37 C.F.R. § 201.38 and 17 U.S.C. § 512(c)(2).

In short, in 2013 the Tennessee Valley Authority was sued for enforcing a ban on costumes at a board meeting in Knoxville after people dressed like zombies protested restarting construction of a nuclear plant they described as a "corpse." In other words, TVA members showed up in zombie costumes to protest, the higher-ups put a "No-Costume" ban to prevent this from happening so the Zombie member's sued the TVA. The TVA tried to dismiss the case and Judge Campbell said that the case could not be dismissed as it may violate their first amendment right.

I had to do more digging, but it appears the lawsuit was dropped after the TVA removed the policy after their request for dismissal was rejected by Campbell (A).

Just a pretty based side-story for context on who Greer is torturing with his bullshit.

If Russ ever wanted leave to amend at any point, he should have just filed the draft petition as an exhibit attached to any document complaining about how he's right before the dismissal was entered. That would "fix" things, presuming it actually corrected his pleading decency (lol), because the Court would just say "we are taking this filing as a motion for leave to amend, and granting it".
