Russ was permitted to proceed in forma pauperis in the district-court action, so he shouldn't need further authorization to proceed on appeal in forma pauperis... correct?

The thing Kosher is confused about is just a standard notice given to everyone who appeals without consideration to the context.

If you read the doc, it seems clear that it's a standard notice the clerk gives.

That's my take on it anyway

Alan Dershowitz is well known to countersue his accusers.
dershovitz was accused of fucking sex trafficking in relation with epstein, that's substantial enough to warrant a defamation claim.
null is accused by russ of what? hosting his book without permission and not deleting mean things people post on this site? that's laughable, no judge will accept that these accusations are defamatory, and no lawyer worth his salt would go forward and bring such a lolsuit against russ.

What I don't get about courts granting IFP so easily is this.. If you can afford to save up and spend $3000 on a hooker for a few hours, and you can afford to save up and spend $3000 for a band to do your audition, you are able to save up and and spend the $500 filing fee. These people need some skin in the game or there's no risk to themselves. Yet the courts overlook all this stuff? It's not like Russ has kids to claim as dependents like Melinda.
they have statutes and regulations about this. like, some official book of court procedure states "if a persons average monthly income over the past X years was less than Y then IFP status is to be granted" and that's the end of it.
 
It's the cost. It's more money to file for damages I will never get. I am essentially paying to go offensive and waste money on someone I can never collect from. I'm going to have to do this with Melinda too. It's a loss just to get GoPro footage from the collection agent to put in some sort of wall of shame for people abusing pro se in forma pauperis to do this. I don't have any other option.

Like I don't think you guys understand how expensive this is. It's destroying any revenue from the merchandise runs. If this doesn't work we don't have any path forward for the site to stay up. We do not make enough to afford continuous litigation that is zero risk for the litigant.

I could try a GoFundMe but chances are that it will be shut down. I think a lot of you post-2018 people don't really comprehend how badly I have been shut down from making money. We don't do merchandise as a first choice, I'll put it that way.

Why would the far.s have to shut dow ? Assume the worst case, that Russ wins on that one point of Copyright infringement. What would the actual damages be? What is the actual worth of these materials? What is the provable loss? Not a whole hell of a lot. Remember he's lost all the defamation claims etc.
Copyright claimants can seek statutory rather than actual damages, which range from $750 to $150,000, depending on whether they're found to be willful, which can be awarded without proving any actual damages. Yes, this is dumb shit.

If I were in your shoes, I'd offer to remove the stupid song that no one has downloaded even though it's fair use. Russ would probably say no though, because like Melinda, I think his goal is to have the entire thread shut down, and he's just using the copyright cause as a diversion.

Yes you can. The main causes of action are abuse of process and malicious prosecution. You can also pursue sanctions under Rule 11 and, in federal suits, statutes such as 28 U.S.C. § 1927 for unreasonable multiplication of proceedings. Most states also have similar statutes. There are also common law doctrines such as champerty, barratry, and maintenance that exist in some jurisdictions.

Yeah I was considering correcting that but I couldn't think of the word for it. I meant in terms of "stop pursuing this or I'll have to seek damages". Offer/ultimatum is probably a better word.

Oof. Saw you mention a fund set up by the lawyers(or something like that) earlier back, and I can say right now that alot of people here would pay into that, myself included. If people were willing to pay Chris money to go to a brony convention where he'd almost certainly try and kiss people again, then there's gonna be plenty more than that willing to pay for something that's actually a good thing instead of just averting Chris somehow getting himself killed on a cross-country trip.

Might be worth a shot, Chris' stayed up until... the incident. Obviously this is directly related to your legal costs and not a brony convention, but it would be interesting to see what would happen if you stuck a toe in the water. I'd give you a few dollars.
 
There's a lot of doom and gloom today because of the fucked up way that lawsuits and finances go but let's not let this completely overshadow the fact that Russ Greer somehow lost yet again at the first hurdle despite being a genius legal mind who has worked "in a law office".

Hell, this time he managed to lose the failure-to-state-a-claim motion through sheer incompetence despite finally having a (single) claim for which relief could have theoretically been granted.

I know this isn't super helpful, but I remember from a college course that there was something like a lawsuit version of a restraining order that could either stop lawsuits against you or massively simplify them that you could get if this was the same person suing you over and over. It took a fuckton more work than a regular restraining order, but the gist of it was that it was a legal recognition that, since this person is just doing this to target you, they now no longer get the standard lawsuit treatment and will be insta-yeeted unless they're clearly suing for something you very obviously wronged them with like assault in broad daylight or something.

Isn't that what anti-SLAPP laws are for? @AnOminous, any input on those?

Florida, Nevada, Utah, and Virginia all have them.

Iirc Null was the one who sunk the gofundme for Chris, since the fear was now that people would be giving money to a rapist and that all the money given so far would go to said rapist.
