I don't think Binger's goal was a retrial. I think he was actually trying to push for a mistrial with prejudice as the only way to really save his career by both dropping the case and getting a symbolic 'win' by forcing the 'biased' judge to act.
Acting in a way that is so blatantly malicious and remorselessly unethical that the judge decides that it is not possible for the trial to be considered fair due to your conduct is not a win for Binger's career.

Neither is losing a massively high profile case, being brought before the bar by the judge, and having been utterly trounced and proven to be a slime-based being. In fact, losing the case is way worse to him.

Kyle standing holding this gun pointing down, like he was literally every other time he was seen -- except when he was having to defend himself.

I actually managed to dig up some drone footage of the night that shows an angle similar to the ones in those pictures, and I think those white outlines might just be something else entirely. Can anybody tell me what those things are?

Please stop. There are a lot of ways for it to malfunction. They have it covered on the video. He never clears the gun. This is retarded. Three witnesses testified to what motion it would take and they have slow-motion of it.

Well, thank God he never got a double feed. He'd be dead halfway through clearing it, if he even knew how.

Kyle doesn't actually rerack his rifle at any point in the video so this is largely a moot point, but you can absolutely clear most malfunctions by pulling back on the charging handle. That particular malfunction would likely be corrected by slapping the magazine to reseat it, and then pulling the charging handle back.
