Actually, it depends. It can't be put in front of the jury, but since the whole "smoking gun" was the whole pixel bullshit, it could absolutely be a justifiable reason to throw out the conviction assuming they come back with a guilty verdict.

Small clarification, but the Swastika is typically on an armband or part of an insignia and certainly not to be placed on a T-shirt like a band logo, that would be below the dignity of that noble icon. Secondly a photograph could not capture the words 'Sieg Heil', so perhaps you're confusing the physical salute with the verbal action? They do often show up together, so I would understand.

In a just society you would be able to send that to the Kenosha court and have the provocation charge immediately dismissed, unfortunately this isn't a just society
