The only takeaway i have is that anyone who even considers using Richards as their lawyer after today should be committed. Barnes may be biased as hell but i think he actually truly wanted to help Kyle unlike Richards who at best is incompetent and worst actually sabotaging.

Do the jury instructions make clear that Provocation requires an unlawful act? If so and the judge uses the defense's proposed instructions for the possession charge, as long as the jury follows the instructions they cannot think "him just being there with a gun is provocation!"
The judge will likely stress this, but it's anyone's guess as to how well it will stick.

I believe that we're at the same time in violent agreement on some points and that we're talking past each other on another.

I agree with everything you've said above, yet disagree with your earlier point about law system acting professionally, because it allowed to select a tainted jury which is not supposed to happen in any case, no matter how despicable the defendant is. We just might agree to disagree at this point.
Oh You may be right about the jury, I have no idea about that. I just thought that you were suggesting that the police officer that killed Floyd wasn't guilty of something, at least manslaughter if not murder. My bad then.


(I.e. that the Judicial process failed...I mean if the Jury is tainted I guess it partly did, but the fact that he was found guilty isn't IMO ).

The judge thought it was a huge burden on everyone and didn't want to unless it was 100% necessary.
It's illegal to aim a gun at someone without justification, which is what they're going for.
But that's easily disproven. The thing to worry about is whether the provocation instructions mislead the jury into thinking "he provoked Rosenbaum by showing up with a rifle" is grounds to convict.

I looked up the instructions
[A person who provokes an attack whether by lawful or unlawful conduct with intent to use such an attack as an excuse to cause death or great bodily harm to another person is not entitled to use or threaten force in self defense.]
So it looks like it comes down to whether or not the state can convince the jury that Kyle intended to provoke an attack, and whether the conduct was legal or not is irrelevant. Hopefully the defense points out how he basically ignored the "protesters" 99% of the time. If he intended to provoke an attack, he would have been talking a lot more shit.

Or they can emphasize that he ran away until he was knocked to the ground. Honestly I don't know if we can expect even that from them at this point.

Problem with this Facebook viral post is
1. It's an attempt to make it difficult to discredit the source
2. The dude named was convicted for domestic violence so he's a prohibited possessor
3. The dude served from 1995 to 1999 in the US Army so what combat zone did he serve in? Haiti/Somalia was 1995 so it was impossible for him to go there as he just joined the army. KFOR was 1999 stood up in June and he left the army in August 1999.
4. Because he was four and out, he was just an enlisted soldier likely got out at E-4 or something so he knows jackshit.
5. He's arguing that your right to self-defense is null and void if you happen to be in an area that's rioting. What if you were incidentally traveling through the area and you didn't know it was rioting? You lost your right to self-defense?
6. Comparing civilians to unlawful combatants is also absurd.

From a few tweets that have been posted here, the jury appears to not be reacting well to Binger, and it wouldn't be a stretch for some of them to be utterly puzzled as tto why this was even tried.
 
The jury isn't sequestered, so why are you assuming they don't know about Rosenbong's kiddy diddling activities? Just because it wasn't brought up in the trial, doesn't mean the jurors never used the internet in 2020. Lots of people know.

But the guys Kyle shot came across as unsympathetic even if you're an alien visitor who landed in Kenosha WI just to observe the trial. Handyman performed poorly under cross examination. Rosenbong's angry gamer word shenanigans were discussed at length. The jury knows these guys weren't there to have a respectful conversation about inner city policing or Confederate statues.

Kyle did well on the stand, and showing emotion over the guys he wasted will help him with the jury. I'm betting on super not guilty.
I assume it because they're normies. The retarded crowd that if they get any kind of politics or news they get it through an osmosis of background noise that is created by the MSM. So I'm not gonna put any high hopes in a random sampling of normies that can't get out of jury duty for a nationally significant case where the media is so slanted. I hope Kyle gets off. Based on the number of soldiers/sailors/airmen/marines I've heard talk out their ass about things like firearms I tend to discredit anyone who uses their prior military service as a reference for talking about anything. Dude is probably a POG that happened to get a CAB because the FOB got mortared.

That was after he showed up to a "peaceful protest" with a rifle. If you are found to have intentionally provoked an attack, you aren't entitled to self defense even if you retreat. It's my general experience that most people who go around saying "as a combat veteran" to justify the dumb shit they say next, are usually full of shit. Half the time they didn't serve, or washed out in basic, and even if they did, they never were deployed in a combat capacity.
