Can JNOV be declared with prejudice? That was the only thing I wasn't clear on.
The state may appeal a JNOV that finds in favor of of a criminal defendant on the grounds that the judge is illegitimately overruling a fair jury decision. Theoretically, that would be a huge mountain to climb in the case of a judge with no black marks on his record in 20 years of presiding over cases.

"Theoretically" because the motion for mistrial with prejudice is far more likely to succeed at 10% than the possibility of a JNOV at .001%. This judge has made it exceptionally clear that he is putting his full faith and confidence in the jury to render a fair verdict, and unless they come back with some shit like "The defendant is guilty on all charges, even the lesser includeds", he will allow their verdict to stand.

Are we actually a Legitimate Journalistic Endeavor now? We seem to be a better and more accurate News source than the New York Times these days. Would that help or wildly hurt Null's Legal problems if we were? It adds Sullivan v NYT to Null's legal arsenal. And it leaves open the possibility that we might be the case that gets it overturned. So wins all around!

I mean between watching Rekeita's Stream all day with around a dozen Law Professionals and Jeremy from Geek's & Gamers follow up stream that had a number of Youtube Comentators and Law types on, I'm pretty sure at least 80% of them lurk here, if not openly have accounts. Looking at that tweet the big thing that jumps out is the implication that nobody asks who KiwiFarms is.

Just woke up what exceptional shit did binger do this time?
Withheld video evidence from the defense, this was mentioned in a motion for mistrial with prejudice that was dated to yesterday. There seems to be confusion over whether or not Schroeder got around to reading it before or during today's session. If he's only reading it after, there's a possibility I guess he'll lose his shit in court tomorrow. No matter what he does with it though this guarantees Kyle can file an appeal if he is found guilty.
