Unfortunately, I looked it up and the EEOC is quite clear -- me dodging the conversation in any way gives them the OK to deny me the exemption at will.

Yes, they're clearly trying to figure out if my beliefs are "sincere." Which means they're actively trying to screw me out of my rights. So I'm going into this assuming a hostile environment.

This thread has me slogging through federal statutes and pulling cases like I'm a 3L again. Memories. My reading of Title VII and the EEOC CoVax specific guidelines regarding the interactive process isn't quite as pessimistic, at least not without having gotten to dig up some cases where that was a specific issue, but it doesn't really matter at the end of the day. I didn't put good odds on an attempt to dodge actually working permanently, unless your employer had zero confidence in whether their grounds for requesting more info was made "bona fide/in good faith" and "objectively based", should this situation end up in an EEOC complaint. I did hope hemming and hawing a bit might get them to show you in advance what it was that's on their minds (what basis underlay their potential doubt of your sincerity, or whether this was actually not so hostile and they just wanted to talk about possible accommodations).

(Sorry if the disclaimers in my lawsperg posts are off-putting, I had it hammered into me to be extra cautious about anything that could get a professional ethics board to dump on me as they were just then discovering this thing called "lawyers talking to people online and OMG how do we regulate that" and shit was extra uptight because there was zero consistency. Hooray for tech illiterates writing rules and literally medieval professional customs.)

After looking at the Barnes template letter, I'm guessing the fetal tissue bit will come up -- it seems to be the most popular point brought up in other exemption requests that are going into litigation, and the most consistently mentioned thing in templates and online discussions. This detail getting circulated in a lot of places online as a silver bullet to getting an exemption approved seems to be getting it red-flagged as likely to be insincere, looking over some guides written by employer-side law firms aimed at bosses. (Archive) It also could open the door to the employer countering with getting an "ethically non-controversial" vaccine later as an accommodation.

If the employee’s purported reason is based on their distrust of the vaccine or a philosophical news article they read online, that will likely not rise to the level of “sincerely held religious beliefs.” But don’t make this assumption right away. Instead, your questions regarding the employee’s stated belief for the exemption should be answered through an interactive process with the employee in which you may be able to – in some circumstances – request additional information or documentation from the employee.

Venable wrote probably the clearest, most concise one of these guides I've come across, and it might be useful to you on both a tactical and a confidence-building level to get a peek at the other team's playbook. (Archive) For background, Venable's a pretty major BigLaw firm, and my impression of them from my (limited) past interaction with those guys is that they have their shit together, and aren't just coasting on inertia from being Hueg. The Fisher-Phillips one linked above the quote is more detailed and also good.

I'd also take a look at this one from Foley-Lardner if you can as well, as it spends time to address a couple points on where an employer can still oppose a sincere exemption request. (Archive) The safety issue in particular is the big one that always comes up in the context of any vaccine fight, especially in any workplace that involves interacting with medically-vulnerable populations.

Employers are permitted to weigh the importance of workplace safety against the religious beliefs of an employee; Title VII does not require that the religious beliefs of an employee be prioritized above safety in the workplace. Case law is clear: “Safety considerations are highly relevant in determining whether a proposed accommodation would produce an undue hardship on the employer’s business.” In Draper v. U.S. Pipe & Foundry Co., the court held that undue hardship can exist if the proposed accommodation would “either cause or increase safety risks or the risk of legal liability for the employer. … Title VII does not require employers to test their safety policies on employees to determine the minimum level of protection needed to avoid injury.”

Though limited, there is some legal precedent, particularly in the health care field, for weighing these considerations and electing to prioritize safety above an employee’s religious beliefs. In Robinson v. Children's Hospital Boston,the U.S. District Court for the District of Massachusetts determined that Children’s Hospital did not violate Title VII by terminating an employee who refused an influenza vaccination because of her religious beliefs. The court concluded that granting the employee’s requested accommodation not to receive the vaccine would have increased the risk of transmitting influenza to its already vulnerable patient population. This increased safety risk posed an undue hardship on the hospital and thus it was not obligated to accommodate the employee’s sincerely held religious belief.

Good luck, and I hope you can get a chance to sit down with a labor lawyer in your area. However this ultimately plays out, more knowledge and understanding tends to give more peace of mind and confidence, and that's always worth something when dealing with an inherently stressful situation.

This last bit is more intended for anyone else reading all the ongoing conversations about religious exemptions who's feeling lost and worried and not sure where to start. The Miami-Herald wrote a good introductory article talking about religious exemptions for CoVax in the workplace aimed at normal people. (Archive) And here's a shortcut straight to the EEOC's guidelines specifically on exemptions and the Covid vaccines, which is a lot less painful than grinding through the entirety of Title VII. Ah yes. You've put in to words far more eloquently that which my midwit brain can barely conceptualise for itself. I've noticed that before on a few things. I always wondered if anyone else did. I couldn't have elaborated on it better than you though, even to myself. It's kind of like a double-negative or double-double-bluff. It's confusing if you aren't paying attention, but if you are, you can see it for the scam it is, but it's still kind of confusing. That article made me prick up my ears and got my radar spinning, but for the life of me I couldn't work out why. I wonder if there is a name for that kind of propaganda mind-game. It's both quite a crass but sophisticated technique at the same time.

IVM has strange side effects, man. For instance: it made me feel more in control of my time. I started being much more productive, also I sleep a lot better. I feel somewhat addicted to it. :)

So far, knocking on wood, I didn't even catch regular sniffles this season. Well, four months of winter ahead, so there is still time to catch something, especially as in January I will start coming to office.

Generally speaking, IVM induced sense of self-control made me limit reading doomer stuff, and so I have more time now for my hobbies. I still don't know if we run out of the cheap useful oil or not, so I wonder if it's better to spend more time on game dev or sewing, or anything else useful in Mad Max scenario :biggrin:

It could be technically true if they're just not admitting the vaxed to ICU, in Ireland the keep pushing "muh 7% of the population taking up 40% of ICU beds" but are keeping quiet on the fact that 100% of the dead in the past week have had at least one dose and the vast majority were fully vaccinated.

It makes you sound amenable and sincere but really isn't actually committing you to anything. All COVID vaccines on the US market are ethically compromised with respect to abortion derived cell lines. I've only heard of one that was trying to be ethically produced but is still in development and it ended up having to test with some of the cell lines in controversy making it no longer acceptable. I could be wrong but I don't know any others in development specifically targeting ethical production. I doubt foreign vaccines are ethically any different or even will ever be available domestically (can't let that outside competition in).

Ultimately it is still up to you to make the determination if any new vaccines are ethically non-controversial and in accordance with your religious conscience. Your objection to a new vaccine could even be for an entirely different religious reason than the fetal cell controversy.


ETA: I just noticed the link as part of the quote and took a quick look. Be sure to follow the subsequent link to the latest table that includes info on testing. There are a few more being developed than I realized. So going that route is a gamble on if any actually ever make it on to the US market. But at worst you'd just have to request a new accommodation at a later date with a different rationale if they even still have the requirement at that time.

Irish government is talking about yanking vaccine passes from people who haven't gotten their third shot. There are also rumours flying around of another lockdown in mid-December, nothing officially leaked/denied yet but it seems a lot of pub owners are preparing to have to shut down again. If both happen they might have a bit more trouble convincing people to get boosters because a lot of normies only went along with it because they were told things would go back to normal, if things are shut down anyway having the pass is beyond pointless. They backed off on extending its use to gyms and hairdresser.

The cognitive dissonance I experience from consuming media that tells me that the vaccines are incredibly effective at stopping infection and illness and then looking at the actual fucking data produced by governments gives me a migraine.

The UK surveillance data clearly and unequivocally shows that the vaccines do zero parts of fuck all to protect anyone from catching the virus. This is not arguable it's simply true.

What's even more amazing is the data also shows that the virus itself is a complete nothing burger.

Overall the mortality from Covid 19 for all ages is 0.4%. Less than half of one percent of the people who catch Covid die from it. Even using the ridiculous inclusion criteria of what constitutes a Covid death, that's a ludicrously low number to be shutting down entire economies and stripping people of their fundamental rights.

Even more hilarious is the death rate for non boomers. People under 50 years of age have a 0.02% risk of dying from the disease. No that's not a typo, 99.98% of non olds will recover from the literal airborne AIDS.

Overall mortality rate for the non jabbed in all age groups is 0.2%. The double jabbed have an overall mortality rate of 0.65%. Again not a typo, looking at the entire population the vaxxed are more than three times more likely to die than the unvaxxed. Why? Because most kids in the UK aren't vaccinated and none of them are dying and that's the whole point.

For adults under the age of 50 being vaccinated reduces your chances of dying from 0.04% to 0.02%. In the media this will be reported as "halves the risk of dying" when in reality it reduces the risk from ridiculously remote to ludicrously remote.

The only people who receive any benefit from the vaccines are the old. So if the vaccines are shit at stopping transmission, which they are, and no one else individually benefits from taking them (but are exposed to the side effects) why the fuck aren't we just jabbing the old?

Am I going crazy? Have I done the maths wrong? What the fuck??

It wasn't tested and if it kills millions (not everyone) then it's not a big deal (in the eyes of the bigger picture).
