no.
the courts grant IFP status based on your personal income. if your monthly (or yearly) income is below a certain level, you qualify for IFP. how you actually spend your income doesn't interest them.
the only way he'd get in trouble over his IFP status is if he had lied to the court by stating that he has less income than he actually has, or if he failed to report major financial assets to the court, and i do not think he has done anything like that.

i think the courts really do not want to bother with micromanaging the finances of every poorfag who wants to file something, and getting into arguments like "you claim you are a pauper, but there you are spending money on nonsense!" would just destroy the entire concept of IFP because in practice the overwhelming majority of poor people constantly throw away money on frivolous nonsense like drugs, cigarettes, alcohol, hookers, gambling, etc.

The IFP order specified that it only didn't apply to subpoena's, and their handbook only mentions that for IFP persons, the court can order Marshal to make service on their behalf (which the court did order). One could presume it's free given the order and the context of the way it was written. Then, mayhaps, his argument is that it would be cheaper for the courts?

IFP filing does open the possibility that the case can simply be dismissed sua sponte under 28 U.S.C. § 1915(e)(2)(B)(ii) without the defendant even needing to reply.
