I don't know much about this, so if you don't mind my asking, how would you go about it if you had the authority?

I can't speak for who you are quoting, but I can think of a few good places to start:

1) Requiring the fair use analysis be included in the takedown notice by the filing party. Currently it is "required" but you don't have to show your work, so it's not "required" at all. This would be an excellent speedbump especially in combination with some procedural changes and liberal "shall issue sanctions" language added to the law for missing or obviously incorrect analysis.

2) Prohibiting foreigners from using the system without an actual lawyer in the USA retained to file the actual takedowns for them. No more of this "DMCA agent in Cyprus for companies in the Canary Islands" shit. Headquarter in the USA or shove money up a lawyers ass at $200 or more an hour to do your dirty work.

3) Some way to drag the complainant into court on the complainants dime for situations exactly like this, though implementing and balancing such a system would be difficult so I won't claim to have the answers on specifics.

The reality is most fair use analysis is not complicated: typical piracy websites do not try to be transformative at all, and don't post the content in a way which can be explained away by fair use, so such a requirement as laid out by 1 shouldn't be onerous for a rightsholder who is sufficiently invested in protecting their IP, but it should provide a barrier to entry which makes a rightsholder think "is it actually worth it for me to do this?" as paying a lawyer for even half an hours's work (which seems to be the smallest time fraction I've seen a lawyer bill) per claimed item starts to add up really fast.

Who would ever go to the trouble to go to court, get a subpoena and search warrant to seize a cat or dog to obtain samples of its DNA to then compare against a specimen of animal waste to determine if it's a match, presumably because someone whined about being mailed a turd? How would you even go about establishing who to seek a subpoena against in the first place?
