DENVER — One person was killed and two people are in custody on Saturday after gunfire erupted near an area where protests between opposing groups in downtown Denver were occurring, authorities said.


The shooting occurred in the courtyard of the Denver Art Museum, KCNC reported.


A man participating in a “Patriot Rally,” which also included self-described Black Lives Matter-antifa protesters, sprayed mace at another man, according to the Denver Post. The man sprayed by mace then shot the first protester with a handgun, the newspaper reported.



The victim, whose identity has not been released, was transported to an area hospital and was later pronounced dead, KCNC reported.


One of the two persons taken into custody was not involved in the shooting, according to the Denver Police Department.

According to a later tweet from police, “further investigation has determined the (other) suspect is a private security guard with no affiliation with antifa.”

Officials said more information will be released “as it becomes available.”

The Patriot Rally was scheduled for 2 p.m. local time, KUSA reported. The counter protest, called a “BLM-Antifa Soup Drive,” began 30 minutes earlier at Civic Center Park, which is located next to the state Capitol, the television station reported.

Police, who earlier fired what appeared to be pepper balls at the leftist protest group, said they were working on a homicide investigation, the Post reported.

Several Denver police officers in riot gear were on the scene when the shooting occurred, KMGH reported. Witnesses said the victim was shot at point-blank range, the television station reported.

The Denver Police Department did not provide specifics about the shooting but released a statement.

“The Denver Police Department respects the right to peacefully assemble,” the statement read. “Those who participate in protests, demonstrations, marches, or other gatherings, as protected by the First Amendment, are reminded to do so in a lawful manner. Individuals who choose to act outside of local, state and federal law, will be subject to citation or arrest.”

Media is in full damage control, the shooter was a "random security guard" who attacked in "self defence" after being maced and is not affiliated with Antifa because Antifa does not exist and is just an idea.

The "first to escalate things" is definitely the important thing here. But the more I've tried to form an opinion of who "started it", the more I realize I don't know how to judge that. Guy shot because he was peppersprayed. He peppersprayed because guy pointed a gun in his face. Guy pointed a gun in his face because he slapped him. He slapped because guy pushed him. Guy pushed him because he got close and yelled in his face. He got up in his face because guy was antagonizing him. And so on. I think the origin of this was just some pissy words that gradually escalated back and forth.

Is "starting it" by talking shit enough to justify a bullet to the head? Or is there a line that was crossed in another action--The first person to make physical contact, the first offensive vs defensive physical contact, etc?

I'm inclined to think the dead man was more defensive during the confrontation: an open-handed slap instead of a punch, he's backed up more than the shooter when the gun is drawn, pepperspray instead of a lethal weapon. I think the shooter was aggressive or at the very least over zealous and unprofessional. I don't understand why a private security guard (not for the property but for a news producer/journalist) is getting into a spat like this, getting so close, drawing his gun, when there was a fucking swat team a few feet away, on his side of the alley. They materialize immediately after the shot. I don't personally believe he feared for his life because of an open-handed slap. And if he did, he only had to retreat a few feet and he would have a wall of police to hide behind. Either way, I don't think a jury will buy that he felt endangered. So for me that whole "who started it" line is the drawing of the gun. Very curious to see how the experts evaluate it though, and how it eventually plays out in court.
Colorado has no stand your ground, and the pepperspray guy was already retreating before a single shot was fired. The shooter likely felt comfortable drawing his gun in front of a swat team because he knew they weren't going to hurt him.
 
Yeah, the shooter is fucked. Nothing from the released photos/videos shows escalation warranting discharge of a weapon. The one picture of him reaching for the mace guy's weapon is also especially damming. Especially after mace guy used an open fist to push him away.

It's looking like mace guy pulled the mace only after the shooter pulled the gun and was using it in an attempt to defend himself.

I get the feeling the shooter got pissy that his "authority" was being ignored and escalated to the point of putting a bullet in a guys brain. If the social media feeds are accurate, then first degree murder is absolutely warrented.

Edit: Also, sad that the victim had better understanding of escalation. He never draws his actual weapon and keeps things in non lethal territory even when he has a targeting laser in his eye.

First degree in Colorado requires premeditation which is incredibly hard to get a Colorado Jury to go with historically. Second degree is a pretty good fit if it goes to trial.

Hopefully a conviction results in life without parole since the Democratic controled legislature and Gov killed Colorado's death penalty this year.
 
Anybody who has watched the animation of the shooting stitched together from still pictures could see that there were gaps in the action, some of which were at the most consequential moments of the altercation. Some people dismissed it as just happened to be when the pictures were taken, and that's that, but that wasn't enough for internet turbo autists. They have now named and shamed the photographer, Helen H. Richardson, and the scumbag Denver Post, which she uploaded all of the other images to, into releasing the two "missing" frames of the shooting, merely by revealing that they were hiding the evidence according to the very naming conventions they used for the photos.

The missing frames, named RALLY_872 and RALLY_873, were the exact frames in which the murderer was drawing his weapon before firing and murdering a man. The two frames surrounding them were RALLY_871 and _874, revealing the obvious fraud being perpetrated with this omission of those two critical frames. These two frames were intentionally withheld by the photographer, Helen H. Richardson, to hide the evidence of a crime from the public. It is the only reason these two exact frames were withheld, there is no other excuse. Helen H. Richardson has responded by going full DFE, as people usually do when they are exposed, and the fucking Internet archive -despite claiming to have archives of her twitter- seems to be playing dumb and won't return any results now. ...very interdasting.

It sounds like at best he was sub-contracted through Pinkerton, but even that is suspect.
Pinkerton, according to reports, has said he was a contractor. Not an employee. Businesses use this "1099, not W2" workaround to distance themselves from liability all the time. Also, it's pretty common for places to serve as just "facilitators" between businesses and private contractors. Open job boards and the like.

Hooray for the gig economy.

Its clearly murder. Knowing that Keltner has a gun doesn't change much of anything, since Dolloff already has his out and could easily blast Keltner before the cross-draw. Cops are literally 50 feet away, Keltner is retreating, and Dolloff had clear escape routes. Even after drawing, Dolloff could have simply held Keltner at gunpoint as he retreated with his 'journalist' or called for the police. Even in the case where presenting his weapon would be reasonable, he had no justification to pull the trigger.

Security Guard Matthew Dolloff to be Charged with Murder in the Second Degree

DENVER—Denver District Attorney Beth McCann today announced that Matthew Dolloff (age 30) will be charged with second degree murder (F2), which carries a mandatory prison sentence of between 16 and 48 years, for the shooting death of 49-year old Lee Keltner.

This incident occurred on Saturday afternoon, October 10, 2020, as Mr. Keltner was leaving Denver’s Civic Center Park where it is alleged that Mr. Dolloff shot Mr. Keltner after an altercation. Mr. Keltner was transported to Denver Health Medical Center where he was pronounced deceased. On October 12, 2020, the medical examiner ruled Mr. Keltner’s death a homicide.

The case against Dolloff, (20CR06007) will be filed in Denver District Court on Monday, October 19, 2020. No additional information is being released at this time.

 
That's a shame, at this point it seems pretty clear that their intention was to start a fight and get a photo op of killing a person. Let's see how it goes, weasels will try to equate this case to the Rittenhouse case, you should nip that in the bud if you catch someone trying to pull that shit.

In March, Denver DA Beth McCann (former state rep Democrat) dropped the case against Doloff instead of letting it go to trial, acting as judge and jury herself, declaring that he was "legally justified" in killing Keltner. “I understand the decision is difficult to accept for those who loved him,” she said.

Doug Richards, Dolloff’s attorney, said that Dolloff was relieved the case “was finally behind him.” Dolloff did not speak during the hearing.

Sister Suzan Keltner said she and her family at first did not speak much publicly about her brother’s killing because they wanted to let the justice system work.

“But we feel like it’s failing. You should go in front of your peers and let the jury decide. But to give up before you start? … It just breaks my heart our city has come to this.”

“Words don’t constitute being shot in the face,” she said. “A slap in the face doesn’t constitute murder, either.”

She said she plans to sue Dolloff, Denver, 9News and the security agency that employed Dolloff (Pinkerton via Isborn Security Services). There doesn't seem to be anything started with any of that yet.

Last June, Pinkerton's license to operate in Denver was permanently revoked because they failed to verify that Doloff was licensed to work as a security guard, so the company was liable for his actions. Last month, judge David Goldberg reversed it on a technicality: the wording of the ordinance included the words "or her".

The relevant Denver municipal code states: “Any act or omission committed by any employee, agent or independent contractor that occurs in the course of his or her employment, agency or contract with the licensee shall be imputed to the licensee or permittee for purposes of imposing any suspension, revocation or other sanction on the licensee or permittee.”

The judge ruled that the law did not apply to Pinkerton because of the words “or her.” Under the municipal code’s definitions, only the words “he” or “person” can be used to refer to both a person or a company. The addition of “or her” conveys that the law only applies to an actual person — not a company, Goldberg found.

“If the City Council intended to include corporate entities within the scope of D.R.M.C. § 32-30(b), it could have simply used “his” instead of “his or her” or substituted “Person” in place of a gendered term,” Goldberg wrote.

Just a sideshow oddity, there was a reddit account linking to one of his old, now deleted tweets asking for money for his legal fund. (The unironic "hello fellow gun owners" made me lol.) He said he's a close friend of Dolloff who is a very good boy. Checked to see what he's up to and his account is nearly all sex stuff. Apparently he likes both altgirls and gay sex and posts nudes of himself seeking meetups with local men.

Because it appears to me that the "his or her" in the statute is in reference to the employee/agent, aka Doloff, a "person," and not to "the licensee," aka Pinkerton, the company, and the judge's reversal was pulled entirely out of his ass.

While I'm sure money was exchanged; the judge's name being Goldberg is what makes me iffy.

That's how I read it too! I was going to summarize that section in a couple sentences but gave up and just copy/pasted because it doesn't make any sense to me either.
