Dramacow FineBros - Copyrighting React Videos Controversy, the Ongoing Shitstorm, Sadly Increasing Subs

Just throwing this out there; but "rescinding" a trademark isn't as easy as they're making it seem.

It's not just paperwork. It's action, or inaction, as well. There's NO WAY they've already filed the "proper paperwork"....especially if they're claiming they're dropping their right to trademarks they already have... it's much harder to stop your own active trademark than it is to just stop pushing for one you have in the works.

So, long story short, they're lying to the people. Trying to appease them I guess? Whether they will actually go through with it is only a matter of time...unfortunately, I can see them claiming to stop this only to continue doing it in the dark.

Good luck on getting those names on your letterhead.

But anyone receiving such a letter should shit their pants.

Honestly, especially on an IP issue, getting a letter with "the law office of Lionel Hutts" should make the average person shit their pants. Doubly so if they've been sending out dodgy DMCA notices. You know as much as I do that someone is going to make a name form them selves soon taking notice/counter notice stuff to federal court as the noticed party and asking for damages from the noticing party because the person signing the affidavit lacked personal knowledge sufficient to have a good faith belief (or was a computer).

I'd like to stress that this is what it took to draw a public not-apology out of them. Not the monetized reaction video about the Sandy Hook shooting. Y'know, the one where they were more than willing to capitalize on murdered elementary school children. The one that is still up and getting ad revenue. That video.

All this salt and schadenfreude is delicious, thank you for asking.

Well, the in-joke here between me and AnOnimous here is that the specific lawfirm I mentioned IS specifically very scary. They are (one of) the lawfirms that IBM has on retainer; and IBM has a reputation of funding/building lawfirms of genuine pants-shittingness. They are nicknamed "The Nazgul of Armonk" because they come from the IBM HQ, they dress all in black, and they destroy everything they touch.
If Bill Gates (or anyone in the IT industry) received mail from Cravath, Swaine and Moore....they would need a stiff drink and a suicide hotline on standby.
Case in point: Supposedly, back in the early 90s, a minor IBM functionary was twolling on alt.religion.scientology and said a few things that pegged the scilons E-Meters into to the red; and the Chruch of Scientology 'Guardians Office' (which is what the OSA used to be called) actually send tons of serious legal paperwork at this guy.....until they received counter-paperwork from one of those "Nazgul" lawfirms....and the CoS backed down.
Yes....those vexatious litigants who have -- as an "article of faith" -- that you must sue and sue and sue, not to win, but merely to grind the enemy into the dirt....saw who their enemy was....and backed the fuck down.

Yeah, but that is the problem. The "person" who "answers" DMCA takedown notices on YouTube is a bunch of scripts on a server somewhere. Apparently, That part of YouTube has been running on autopilot for almost a decade.
Thing is 99% of these specious DMCA takedowns are hurled out by butthurt weebs who will never, ever follow through. Anyone who counterclaims wins because the DMCA abuser will not fight the counterclaim.

By the way, the Swine Bros posted the following on Medium: https://medium.com/@FineBrothersEnt/a-message-from-the-fine-brothers-a18ef9b31777#.ocqa7qgvf

A message from the Fine Brothers
Hello,

We’re here to apologize.

We realize we built a system that could easily be used for wrong. We are fixing that. The reality that trademarks like these could be used to theoretically give companies (including ours) the power to police and control online video is a valid concern, and though we can assert our intentions are pure, there’s no way to prove them.

We have decided to do the following:

1. Rescind all of our “React” trademarks and applications.*

2. Discontinue the React World program.

3. Release all past Content ID claims.**

The concerns people have about React World are understandable, and that people see a link between that and our past video takedowns, but those were mistakes from an earlier time. It makes perfect sense for people to distrust our motives here, but we are confident that our actions will speak louder than these words moving forward.

This has been a hard week. Our plan is to keep making great content with the help of our amazing staff. Thank you for your time and for hearing us out.

Sincerely,

Benny and Rafi Fine

*This includes “React,” “Kids React,” “Elders React,” “Lyric Breakdown,” etc. Please note: It takes a while for the databases to update, but the necessary paperwork has been filed.

**Content ID is YouTube’s copyright system that automatically flags content that looks like or sounds like copyrighted content. This mostly flags videos that are direct re-uploads of our videos (which is what the system is built for), but if you know of a video that has been claimed or removed incorrectly, please email us with “false claim” in the subject line.

Being honest the Fine Bros probably took the best action possible announcing that they were dropping all trademark applications and the React World idea. This wasn't going to go away, especially with stringently insisting the plan had honest intentions and was innovative and ground breaking for the internet like they did in their update video.

It's just incredibly transparent that ir took them to lose hundreds of thousands of subscribers and to risk wrath from their sponsors before they took this action. You can just tell if reaction had been negative but they hadn't been attacked in these ways they'd have stuck to their guns and that makes me glad to see their brand suffering so much.
