They're plastic, so most states allow it actually. Know a girl who carries the exact same one on her keys.

Edit: NY state laws allow non-metallic push daggers, which this arguably is. Only charges are the assault (not with a deadly weapon or attempted murder) Brass knuckles are only illegal in California, Michigan, Illinois and Vermont. Plastic variants I know are illegal in MI, but haven't looked up the others. Concealed carry laws may apply in some states too.
Looks to me that the weapon is legal.

Also, yeah, this was at least partially a political prosecution. They wouldn't have gone through the trouble or taking a rando to court over it.

I wouldn't worry too much about the bum. I'd be looking into who he's been hanging around with, who bought him his liquid courage, and who passed him a weapon that is basically an antifa calling card (look into the symbology of the black cat in anarchism).

This was not a real assassination attempt, this was meant as a threat. "Look how close we can get to you. Your security team is compromised or incompetent. Next time, we may just pass them a gun instead of a calling card."

Actually killing a candidate would trigger possible repercussions, so they're not going there yet.
