Several dozen people arrested onsite at Jan 6th were deemed dangerous or flight risks (not sure what the criteria was, if it was people with previous violent records or if it was completely arbitrary) were being held without bond in solitary. Haven't checked in on it in a while so idk if it's still going on, but that was the case as of April of this year. 1st Amendment doesn't cover trespassing/vandalism/breaking and entering (which is what the govt can at most stick some of the protesters with, legally). There's scuttlebutt about guards ushering some people in but I don't want to get derailed.>Be American

Many people who were there at the rally got encouraged and swept along and just wandered in to the building after the cops had fallen back and the entrances were busted down. Those people got charged with trespass etc, and I can’t see any in that category who served any jail time at all.1st Amendment doesn't cover trespassing/vandalism/breaking and entering (which is what the govt can at most stick some of the protesters with, legally).

this guy got 8 months.Though he only pleaded guilty to a single count of “obstruction of an official proceeding,” defendant Paul Hodgkins — whose criminal act entailed milling around the Senate chamber for approximately 15 minutes — nonetheless found himself branded a “terrorist” in open court by the US Government. Per prosecutors’ own admission, Hodgkins committed no acts of physical violence, and wielded no weapons. He was also never formally accused of any “terrorist” offenses, at least in a way that the Government would actually have to prove beyond a reasonable doubt. Regardless, prosecutors have now introduced a theory in which it’s alleged that Hodgkins and other non-violent Jan. 6 defendants were operating within a supposed “context” of terrorism — and it’s this “context” that they’re citing to argue for more severe punishment. x
