It feels like a more distant, innocent time where you once joked about Chris becoming homeless and running afoul the other, even more crazy homeless cats in Charlottesville. Now it’s like it’s not “if” it’s “when”.

Do you law talkin kiwis see any concern about this setting any damaging legal precedence should this strategy somehow work? Like every rapist on the spectrum(let’s assume it’s a pretty fucking high percentage) is going to start using the Chandler v Virginia defense?

The precedent will be small. Virginia's circuit court is the lowest court of record. Precedent flows downward from higher courts, so I suppose district courts in the same circuit can use the decision as precedent (or at least in Greene County), but not much else.

Other cases can refer to this decision though, not as binding precedent, but just as an example.

Binding precedent would occur if the decision were appealed to a higher court (Virginia Court of Appeals, and then the Virginia Supreme Court).

If they give him a social worker or other similar helper as a condition of his parole, the chance of him getting one that will put up with his crap for a second is slim to nil.

The guy's job will be to guide Chris through major life choices, now normally this is a "You can lead a horse to water situation." But in this case the person in question can make recommendations with real weight to the court.

Sure, could get someone useless, but even then, it's still a human being, let alone someone who is from the south. They will be keeping an eye on Chris .

Not even Chris' parents were able to do that with him. As you say, the person in question would make recommendations to make Chris understand "Chris, don't do x, unless you want to go back behind bars." Kind of sad the judicial system being the ones to parent a 40 year old child, but Bob, Barb and Chris brought us here to this moment.
