Yes. If police are performing an entirely justified search and encounter something in plain view in the ordinary course of that search, they haven't engaged in any misconduct that would justify excluding evidence. Actually, if you are of Scalia's view, the exclusionary rule is a court-invented novelty that isn't anywhere in the Constitution anyway and should be abolished.

I'm not sure whether there's yet a consensus to overturn that, but I wouldn't be surprised to see it revisited in the near future.

I'd actually be skeptical this is the case, and it could just be he's running into the standard cop thing of assuming anyone with bad thoughts and bad guns must be intending to use them. The actual "threat" was pretty vague and didn't seem to be threatening to do any specific thing.
