Phil can say it's his content to begin with, which is true. He said it's not transformative (which is true, it's his content pieced together with parts cut out). There is no commentary, no fair use, nothing that makes it AJ's. Therefore, he is reacting to his own content which is perfectly fine.

Even if you don't think this is a valid argument, any dent watching Phil will agree completely.

you have to remember DSP literally hates playing games, the stream chat plays for him. He is fat and the door dash will slowly kill him, and because he has no impulse control on his wallet He's stuck in this hell having to stream for numbskulls twice a day unable to play with others without trolling and drinking himself to sleep (wow what a wonderful life). The second something like a medical emergency, car repair, whatever comes up he'll probably be sucked right back into the debt blackhole. With Covid winding down I doubt DSP could get away with fraud twice... I hope...

Its almost the same scenario as the sargon case which ended up being determined to be fair use.

Its obvious aj's video was critical of phil and was not meant to try to pass Phil's work off as his own. No one would think aj's video was an imitation of Phil's videos. Its clear-cut fair use all day.

He doesn't think before he speaks, largely because if he suddenly did grow a respect for reality, he wouldn't be feeling like speaking at all. So no matter what, as long as he's trying to bullshit his way to getting back in the good graces of people he incorrectly thinks are very different from the folks who dedicate themselves to shitting on him, he can't pull it off. He doesn't get to fool people, the only DSP who will ever be redeemed is the one living in another timeline.

And since we know for a fact that normal folks laughing at or disregarding him chaps his fat pasty ass, he "wins" battles just from being himself, but loses the war. After all, he reaches for all kinds of pathetic things to taunt us with, but never the money he makes, because he's too scared of the admission that we're right.

I honestly wonder how much sexual humor Phil would understand, given his obvious lack of experience, and/or desire. Plenty of young, uninitiated guys miss even direct signals because they can't believe their luck, but Phil clearly didn't want it anyway.
