Ever heard of the Purity Spiral? Sometimes just having the "right opinions" isn't enough. One thing about radical and extremist groups is that they do a lot of purity spiraling to ensure that one of their own don't become descenders or if they decide that they want to go rouge later on.

I mean look what happened to J.K. Rowling, I remember back in my day she was considered one of the edgiest people of the 2000's because she pissed off the Rightoids at the time for her left-wing views. Now she's considered "far-right" and it's simply because she made remarks about how transwomen are not biological women because no amount of chopping their wieners off will change their genes to female and because of that J.K. Rowling was labeled a "thought criminal" for saying such a thing and so the Leftoids threw her under the bus for not being as radical as they are despite that she's still technically part of the left-wing side of the political spectrum.

So if Stephanie Sheh is going to get replaced, the purity spiral of that lefty West Coast culture demands that she must be more radical than she already is in order to not get kicked out from the in-group and if it means shitting on Vic then so be it.

This is how dictators and cult leaders control their people using fear and moral grand standing to have an iron grip on who they want to control, it's a vicious cycle anyway.

Rial testified that when Dahlin came to the hotel room’s door, Mignogna jumped up and answered it.Rial recounted that Dahlin had asked her if she was okay as they were leaving and that she had told him she was fine because she was “in shock the whole time.” In his affidavit attached to Mignogna’s TCPA response, Dahlin stated that he had no recollection of the November 2007 incident. Now from how I'm reading it, it seems like they know Dahlin very clearly doesn't remember what happened to Monica from actually happening, contradicting her. They then say his "I would remember it" statement is just speculation. But that doesn't make his preceding statement speculation. However, if his affidavit is in the second pleading shouldn't they say that despite what Dahlin says it doesn't matter cause the court didn't consider it. They cite case law for his "speculation" but they don't cite anything for him not corroborating Monica's story.

I assume not. The court said it was proper to not consider anything from the second amended petition, while also saying the depositions, Erica McCord's declaration, and Stan's affidavit were properly in the record. Ergo, it wasn't in the second amended petition.

Your bringing up the whole "I would remember it" = speculation thing makes me wonder. This opinion reads a lot different from the other TCPA opinions that we've looked at while waiting for this one. It just feels different if that makes sense.

Looks like the appellate court is writing an explanation for the Chuppening that gets them to this outcome. As I recall, it was not clear from Chupp's opinion if he considered the 2AP or not. Am I misremebering? I seem to recall that, or was part of the appeal that Chupp DIDN'T consider it--and should have? Been 2 years boyos, I can't hold every detail...

This might explain the difference in tone?
 
What is KV even fucking arguing about anymore? It's clear they don't like Vic, but now you can't even openly say you like the guy without the fucking court case being brought up. On top of that, they have been playing this long game of telephone where now he's somehow straight up a rapist/pedo/whatever other slur they have made up inserted here, and if you support him you're a piece of shit.

Throughout the entirety of this whole thing Vic has publicly stayed professional, to the point, and consistent. Monica, Jamie, etc, have constantly stoked the fires, laughed like a pair of hyenas and changed their story multiple times. How the fuck do more people not come to terms with what's happening? When you try to point out anything about the facts, they'll hyperfocus on one minor thing you (or someone else) mention and then use that to obfuscate the whole severity of what went down. I'm a former KV, and I feel like such a piece of shit for even being a part of that whole movement after realizing too long after the point what was happening behind the scenes.

I don't think it's hard to imagine that anyone should be able to have a turnaround of opinion, but these inhuman shitheads really push believability out the window. I'm fuzzy on the lore of 2019 too, but if I remember you're about right. He just simply ignored the second amended petition without ruling on whether it should be admitted or stricken.

In retrospect, Ty should have gotten an objection into the record, but I don't think he ever challenged the non-decision on the second amended. Then again, the 2DCOA clearly didn't like how that was handled, so any objection would have been "Fuck your Tylphone notary, retard."

1. There has been ZERO fact finding on what he was accused of, everything still falls apart when slightly questioned, Vic has been the only one consistent in his stories and in what happened.

2. This has only been explained hundreds of times on the GFM, on Nicks streams in where that money went and where it was going to and what its use was. It is being used for its intended purpose and will help Vic with legal fees, that is all.

3. Losing an appeal doesn't make everything automatically true, you can lie and change what the 2COA wrote in their decision (which seems to agree he has a case, just Ty utterly fucked it up by not getting things in on time)

Funny they mention QF, his harasser and her autism squad never stopped their harassment campaign even after she went to court the first time. Now that it coming close to court time again for her, she's changing statements to save face so she probably continue to get her fellow tards to keep attacking him. That's some genuinely baffling reasoning that apparently is precedent in Texas which sounds like something their Supreme Court should take a look at (not that it would change the outcome of this case). Stan is saying he didn't remember anything like that happening because he'd have remember it if it did, but the court is reading it as speculation?

However, that's still on Ty/his team since the proper procedure is eliminating ambiguous statements like that in affidavits to whatever degree possible. It's pretty clear what Stan's perspective on the incident is, but there's potential ambiguity in his affidavit.
