Here's the thing, this may be true but a lawyer says "that's an argument".
Prince's lawyer, would likely say the same about the argument that defendant admits their intentions in these tweets, takes credit for it in these tweets, here they are doing this, yes these are true and correct copies taken by myself etc. and oh by the way here's the monetary loss suffered over this period.
I don't know about arguing damages in terms of stock value decreases since I think there'd be a lot more lawsuits if this argument flew at all, but in a hypothetical where this argument does fly, it would be funny forcing Keffals lawyers to argue in court that they actually had nothing to do with the value drop because that's the best defense for their client.
