The problem is the CRA provides no clear standards about what discrimination is. It's up to the judge. The major flaw in your argument is that the law is fairly vague in places that can be interpreted any which way you choose to advance your point. Lawyers live off that shit, but more importantly, it allows for good litigators to twist the law into knots and deviate from the original meaning and intent, especially if their arguments dont rely on the congressional record. This morning, the Feds filed a lawsuit against the State of Arizona for him doing so because he placed them on "federal land" and the Feds want them removed immediately. Ducey basically responded with "fuck you... show me what barriers you're going to put in place and your timeline for doing so and THEN I'll remove them."
So, looks like a showdown a'coming to the Yuma area OK Corral.
But this just solidifies the fact that the Feds WANT the border open.

My biggest issue with CRA is that it's constitutional basis for private action is in the commerce clause, which makes absolutely no sense. I'd prefer Thomas's interpretation that it should be based in the 14th Amendments Privileges and Immunities Clause, which it sadly isn't because of some clearly retarded decisions made in the 1870s.Bullshit. The Age of Entitlement very clearly laid out how the federal apparatus moved with lightning speed to abuse the CRA the second it was enacted.
