:null: I erroneously featured this stating that Klein was suing Kavanaugh. He is not. Klein bought a domain asking if Kavanaugh looks like Harvey Weinstein. Kavanaugh is suing for damages, I believe for defamation. The California anti-SLAPP statute (which is similar to the one in Texas brought down Vic's lawsuit) is very strong, but Kavanaugh has met the burden of evidence to proceed. Klein is now in an expensive phase of proceedings where he must actually argue the facts of the case, and is on the hook for a lot of money.

The judgement is particularly damning because it includes language that is indicative the court already believes Ethan is guilty of the charges and he is now fighting a losing battle.



It also references statements that Ethan has made on his H3 podcast after the lawsuit was initiated and that he could incur additional damages every time a knowingly false statement was made on H3. From what his fans are saying, he has reiterated his claims dozens of times.

Ethan's response has been to insult the judge as a "crusty old fuck" and say he's appealing the decision.

That looks right. It even has the text of the latest order swatting down Ethan's SLAPP arguments, of which this is the only semi-interesting part:
Even when measuring the sufficiency of the evidence of malice under the clear and convincing standard, Kavanaugh presents prima facie evidence of actual malice. Klein republished Spar’s accusation that Kavanaugh was operating a Ponzi scheme based entirely on the June 2019 Variety article. Klein’s statements were made in June 2021 through October 2021, long after the article was updated to reflect Spar’s retraction of the accusation. The updated Variety article quoted Spar as stating that his prior allegation was “not accurate.” The updated article also indicated that Spar and Kavanaugh did not intend to legally file their complaints and the documents were filed by “mistake.” See Defendants’ Compendium of Exhibits, v. II, Ex. 94. The updated article contained statements by Spar disclaiming the truth of his original accusations. A trier of fact could conclude that Klein intentionally disregarded Spar’s retraction, intentionally concealed the true status of Spar’s accusation and knew Spar’s accusation was false because Spar himself said it was.

In addition, circumstantial evidence regarding Kavanaugh and Klein’s acrimonious litigation supports a finding that Klein recirculated Spar’s original accusations knowing they were false or with reckless disregard as to its falsity. Based on the podcast episodes, Klein was clearly expressing hatred and disdain for Kavanaugh personally, and he was trying to goad, insult and humiliate Kavanaugh by repeating Spar’s retracted accusations. See Plaintiff’s Compendium of Exhibits, Exs. A-H.

Defendant Klein testifies he did not find Spar’s post-settlement statement to Variety credible, because (1) the Verified Complaint was made under oath but Spar’s post-settlement statement in Variety was not made under oath; (2) it seemed implausible that Spar would do such an about-face so shortly after filing the complaint; (3) the explanation that the complaint was filed by accident was completely implausible; and (4) Spar never provided the factual basis for his statement that his Ponzi scheme accusations were “not accurate.” See Dec. of E. Klein, 13. “Ultimately,” Klein told his audience they would have to decide for themselves whether to believe Spar’s verified complaint or his post-settlement statement. Id.; see Defendant’s Compendium of Exhibits, Vol. I, Ex. 8, 51:50-54:50 and 1:45:20-1:47:50. At best, Klein’s evidence raises a triable issue of on the element of actual malice.

Really, this whole situation just proves that you can fuck yourself over if you have a big mouth and a hatred that blinds you to the stupidity of your own actions. This retard really thought that he could skip over the "update" to the article and just tell his audience a retracted narrative, all the while expressing how much he hates the subject of the article, how he wants him to fail, etc. And then (in a part of the order I didn't quote) he actually argued "well, it was just, like, my opinion, your honor."

I don't like most defamation suits, there's just something about leveraging the power of the state in a mud-slinging contest that makes me uncomfortable... however, I can't help but get a chuckle when someone tries so hard to fuck around and then finds out. It's like a kid waving her arms frantically back and forth an inch away from her brother and saying "I'm not hitting you, I'm not hitting you" until he finally kicks her in the shin.

Kavanaugh really baited Ethan in telling him to stop talking shit on "his toy podcast" about Kavanaugh being unable to drive legally due to DUIs, not paying a mid-wife/newborn live in nurse a year's wages, bankrupting multiple companies, and citing many of his criticisms from LA industry magazines.

Kavanaugh was ordered to pay $60K in court cost fees regarding the first lawsuit's dismissal, but now Ethan's possibly on the losing end of slander and libel, so we'll see where this goes. Kavanaugh is the kind of rich asshole who gets rich by driving other people's shit into the ground but skimming off the top & abandoning ship before it goes down.

Even fucking Chris Chan didn't insult the judges in his criminal case, now this fucking imbecile did it publicly. If there was any goodwill left in the Judge's heart for this case, it's certainly fucking gone now!

Fuck, Ethan is almost fucking 40 years old. He has to grow up soon, otherwise this won't be the first time he's fucked his own family's well being over a cheap joke. I swear, it looks like some horseshit out of an Adam Sandler movie where his character doesn't believe he's dealing with an actual Judge and keeps making a clown of himself over and over again, except it's from a real guy with a wife and kids to care for.
