He didn't hire Randazza because he was the best lawyer for the case or because he was a specialist. He hired Randazza because Randazza is his hero, and he wanted an excuse to talk to him. Let's break it down:

• Nick sees himself as above ethics rules, and so does Randazza. Randazza's license has been suspended in 4 different states. Nick has only gotten close to getting in trouble in one state.
• Both of them also see themselves as "exceptional" when it comes to conventional wisdom. Both have gone out in public to comment on their case before it has even started. There's a reason that everyone from the local meth dealer to Martha Steward gets the advice to STFU about their case.
• Nick is a noted swinger and coomer. Randazza is an ex porn producer before pivoting into porn law, and eventually trying to go legit as a first amendment lawyer. He was the ultimate coomer - he needed to coom so hard that he made his own material.
• Randazza is known for being a first amendment lawyer primarily due to his work on the law around porn. He is an actual "libertarian justice warrior" (really, a libertine justice warrior). Nick desperately wishes to stand up to "the man" for personal liberty in the same way. Nick reveres Randazza the same way he reveres the guy who made the killdozer.
• Nick is a terminal clout chaser. A small town lawyer, or even a real defamation specialist, would not be able to give him the clout he wants, he needs someone with a media presence that is bigger and more legit than his.

Like his recent automobile purchase, Nick wanted the fancy token and symbol of wealth. He bought a car that was WAY too much for him and WAY overpriced for what he can do with it. It can go both ways, in a jury trial Rekieta probably wins (Assuming the jury doesn't flat out hate both of them). Eventually but they can generally get past a motion to dismiss. Damages are presumed, but not throughout the trial.

The original filing was absolutely pathetic, though, and lacked a single actual defamatory statement. They've amended it, I'm assuming adding some actual defamatory statements (like calling him a pedophile with no apparent basis for it), so it's hard to know for sure how that goes.

I don't think the statements could be taken as more than hyperbole, but if it gets in front of a jury that's a gamble, and I don't think a raving lunatic like Montagraph can prove actual damages, but hey, again, it's not something you want in front of a jury. You don't want anything in front of a jury, ever.

So best case this is chucked at the motion to dismiss or summary judgment stage, but genius Nick has apparently already antagonized the judge and is being a dick to everyone involved in the proceedings.
