Well. Speculating. Rekieta isn't really into doing research. He never has been. He generally (IMO) has the knowledge of a recent law school graduate combined with Libertarian political views and a very high level of self-confidence. I think its perfectly in character for him to have watched streams or read something that explained the national trends in cases like this while he would disregard the question of state law entirely. I also always got the impression that his brain damage thinking process was causing him to think more about the content possibilities of the lawsuit for his streams than thinking about how the law would apply.If we could find this stuff with the most basic Google search, surely Rekieta, with his access to LexisNexis and the other great tools for looking up case law, surely he'd found it as well. Why wasn't he addressing it? How come he wasn't telling us that it didn't apply because X, Y and Z?
But this case may explain why his attorney is so fixated on what laws of what state the case will be done under. Its not a bad argument that because Monty doesn't live in Minnesota that the particular interpretations of that case on per se defamation in state law should not exclusively apply. It would certainly make alot more sense than somehow applying the anti-SLAPP laws of Colorado in Minnesota State court. If one were to assume that the case is not going to be dismissed early, its actually a reasonably smart direction to go in IMO.
