Nick offers all sorts of weird legal theories about his case. But unless Nick's attorney makes those arguments, they just are not very interesting. If "they" is Monty's attorney, its pretty unlikely no matter what mistakes he made in the affidavit that he is going to be deposed. This is similar to the theory that Nick is somehow going to get the case in Minnesota state court conducted using Colorado law and win based on Colorado's anti-SLAPP law.
Almost every stream now, Nick has some "gotcha" moment he talks about where the other side has made some fatal mistake that means the case is over. But its early days. The case has a long way to go and the odds are still all in favor of Monty losing no matter what his attorney does.
