Tavistock gender clinic threatened with court action by watchdog
NHS Trust has until May 5 to provide a new response to parent's FoI request or ICO could write to High Court

The NHS Tavistock gender clinic has been threatened with court action by the information regulator after failing to reveal its relationship with Mermaids.
The Trust claimed in response to Freedom of Information requests from a parent that it “does not hold” emails or minutes of meetings between staff and the controversial charity, which has been accused of putting pressure on staff to transition children.
The matter was referred to the Information Commissioner’s Office (ICO) which has now ruled that “on the balance of probabilities”, the Trust does have relevant emails.
Mermaids has previously accidentally published emails between Susie Green, then chief executive of the charity, and some of Tavistock’s staff. That data breach led the ICO to fine the charity £25,000.
The Tavistock and Portman NHS Foundation Trust has until the end of this week to conduct fresh searches and provide a new response or the ICO could write to the High Court and the issue “may be dealt with as a contempt of court”. If found guilty of contempt the Trust could face a fine.
'The NHS has a duty of candour'
It comes after concerns were raised within the Trust that the release of information under FOI laws was effectively being blocked because of the “potential reputational impact”.
The trans clinic is due to close after concerns were raised about its treatment and an independent review found that it was “not a safe and viable option”.
It has since emerged that staff from the controversial clinic will be involved in setting up and training staff at the new regional centres which will replace it. The Tavistock was originally ordered to close this spring but is still operating.
The parent who placed the FOI told The Telegraph that it is important the truth of the relationship with Mermaids is revealed so that lessons can be learnt.
“What concerns me is the way that NHS policy making can be influenced by a special interest group. There should be a clean break and the Tavistock should disclose whatever they have,” they said.
“NHS trusts have a very powerful self-protective reflex, but the NHS has a duty of candour and that should be respected.”
Mermaids’ influence on the Tavistock was cited by some whistleblowers as one of the reasons why it lost its way, with claims that activists put pressure on clinicians to affirm children’s belief that they were trans and to prescribe potentially life-altering drugs.
The Charity Commission is currently carrying out a statutory inquiry into Mermaids amid concerns over its governance and management.
The FOI request asked for details of emails sent between Ms Green and Trust staff and records, notes, or minutes of any meetings with the charity boss between 2014 and 2018.
The Tavistock originally refused to provide the information under a section of the law which allows them to deny “requests which have the potential to cause a disproportionate or unjustified level of disruption, irritation or distress”.
But when the ICO asked them to justify that refusal, the Trust withdrew it and said instead that following “an extensive search of emails … the Trust does not hold the requested information”.
In a judgment published at the end of March, the ICO said that they believed some information was held, adding: “The Trust must conduct fresh searches into the requested information and provide a new response which is adequate for the purposes of FOIA.”
May 5 deadline
The Trust has been given until May 5 to provide a new response.
It is a criminal offence under the FOI Act if a person alters, erases, or destroys information after it has been requested.
It is not the first time issues with the Tavistock’s FOI responses have been raised, and in 2021 the Board of Directors was told that all requests relating to the gender identity clinics for both adults and children were being “hampered”.
Communications staff had to clear all requests and they had “not approved GIC responses with waiting list data due to poor performance and the potential reputational impact”, meeting minutes show.
A spokesman for the Trust said: “We have noted the ICO’s recent decision and are proactively working toward supplying the relevant data before the deadline.”
At this point their reputation is rock bottom so it can only go up. Fines will be paid out of the public's money. They have nothing to lose and a lot of careers that would be permanently ruined by the truth with the possibility of actual criminal charges for individuals.I don't understand how the Tavistock can keep getting away with it. They sandbag every request for any kind of data no matter who asks for it and never seem to receive any consequences for that. Even when the requests are for things that any sane person would think are urgently important (e.g. patient comorbidities and outcomes of vulnerable children being given untested experimental hormone treatment)
Normally I think a cockup is more likely than a conspiracy, but when it keeps happening I can only assume they do have all the information being asked for and it's far worse than even we can imagine.

No, it isn’t rational, but then we didn’t end up here by these people acting rationally.

Green and Hewitt discussed some tactics to “shift the HSE” by pressuring politicians within Ireland’s legislative body, the Oireachtas. Green and Hewitt mentioned severals legislators by name (TDs), but unfortunately I was not prepared to record the names as I heard them, however it’s likely that one of them was Roderic O’Gorman who advocates for teaching transgender topics to gradeschool children.
Here’s the bottom line: TENI, a group that has received millions from HSE, brought EPATH to Killarney, Ireland, where its representative Tara Hewitt plotted with Susie Green to undermine the very service that was helping to fund the event. GenderGP is infamous for bypassing all the standards that WPATH (and by extension EPATH) attempts to establish for ensuring that there are minimum guidelines for the treatment of all people seeking cross-sex medicalization.

This is what trans youth support charities should be saying in defence of trans young people in the face of a health service that is failing them. Trans healthcare is a disgrace in this country, and no more so than provision for young people.
I think this is the key part of the whole post. It is not really a letter to Cass but instead to trannies. The interim Cass report made clear that puberty blockers are an experimental treatment, and Cass says in the post Webberley is ostensibly replying to:To focus on the long-term model and turn your back on those gender incongruent young people who need access to blockers and hormones now, will cause untold harm to these young people.
It seems unlikely that Cass would agree that children on the waiting list "need blockers now"! (Those already off the waiting list and prescribed blockers under the GIDS regime are continuing to receive them, as I understand it.) There are no new referrals for puberty blockers(!!!) because the Cass review has found them to be an experimental treatment which should only be administered under research conditions (which GIDS referrals absolutely were not).I hear there are no new referrals being made to NHS paediatric endocrinology at UCLH. There is currently no access to NHS endocrinology and this urgent need must be addressed. People need to understand how you intend to advise NHS England to triage urgent cases and provide care to those who need it today. It is simply not good enough for doctors in this country to be saying that they are not equipped to provide this care. They need to be taught immediately and I am very happy to teach them.

Stop feeling the need to defend your position to those who demand ‘research’.
You know that it feels better when your body, mind and hormone profile matches your gender identity. Why wouldn’t it?
