A normal sex offender only stands half a chance at surviving an overcrowded prison. Nick Bate isn't a normal person.
His body might survive longer than a year. His mind won't. But his body might survive the entire sentence, and for the exact reason you said.
Full disclosure, I'm not involved with any correctional facilities, or know anything about the law, or etc. But it's pretty obvious that Nick is weird. Weird enough that throwing him to the wolves is a legal question mark, and one that might be easier to avoid just by not letting Nick interact with much at all. Staring at a cell wall for 23 hours a day is intense for a relatively normal person. For someone from the "Overstimulated Tumblrista" generation, Nick's psyche is going to shatter into bits.
Physically he might come through though.
This would require him to have much of a mind to begin with. Will be like smashing an already busted window.

How do things like combative behaviour (ie. refusing to bathe, etc.) play into this? Just curious if that type of stuff is considered when dealing out sentencing.
For instance, say he insists on wallowing in filth and generally being a nuisance for his entire stay; would they be able to tack on more time, or is 40 years the max?
I know if he commits a crime in prison, they'll add time on, but am unsure how behaviour works. I mean, I know one can be released early due to good behaviour, but what about the inverse?
Or is this where stuff like nutriloaf come into play?
Sorry, the penal system in Canada is very different, so I'm genuinely curious.

You have to be relatively squeaky clean to get parole...and we know how un-squeaky clean Nick is.40 years is the max. Sentencing depends on a combination of how the judge feels that day, victim impact statements, and mandatory minimums.
He was given 16.5 to 40 years. This means that he needs to serve 16.5 years at a minimum, before he's eligible for parole. He's not getting out before that at all. After, it's up to a parole board to determine if he ever comes out before the 40 years are up. It's conceivable that they'll deny him every single parole opportunity since he's an extreme case and danger to society, so Nick really is looking at the full 40 years.

If he gets into an altercation with any other inmate, this will also hurt his parole chances.
But let's imagine Nick getting out in 17 years on parole...he still has to check in with his P.O. every so often (whatever they decide) AND he has to register as a sex offender for a very very very very long time after that. Some people seem upset that he "only" got 16.5 years until Parole; but parole, as you said, isn't guaranteed. It's not a right, it's not a promise, it's not owed. It's a privilege an inmate has to earn.
And that's if he lives long enough. Pedophiles don't have a good history of making it out alive.
