In fairness the judge did use the word "premature" several times.

A Ctrl+F search of the document reveals she used the word "premature" 4 times.

Dealing with each instance:

1) The motion is premature because discovery has not happened and it is therefore improper to make conclusions about matters such as emotional distress
2) Discovery is essential to ensure that meritorious claims are not thrown out and that the other side has a chance to produce evidence that might defeat summary judgement
3) Says that reputational damages have not yet been proven but that the defamitory terms used were such that they would inspire negative things about the target of them. The judge also accepts Monty's argument that the motion is "procedurally defective" (p.11).
4) In the conclusion it is once again argued that the motion to dismiss is premature and that discovery is required.

I don't think any of those four uses of the word line up with the ideas in Nick's tweet as to what he thinks "premature" means. Nick and certain others are acting to a degree as if "premature" implies they cannot lose and that this effectively a procedural delay. That is not the case.

I would also be careful of reading too much into the use of the phrase "public figures" in the opening sentence of the document on page 4. I would personally not assume from that a decision by the judge on the matter of Monty being a public figure for purposes of the case. I think if that decision had been made, it would have been explained in the document at greater length. Or at least the question of what sort of public figure Monty is would have been dealt with.

The judge has outlined future expectations rather clearly. There is a clear threat in the document that if Monty's side can't make better arguments in certain areas by the end of discovery, that a summary judgement against them will be likely. But I don't think Nick's interpretation of this as a simple "procedural" delay of his inevitable victory is correct.

Nick is not any kind of lawyer with any experience. He built his channel on tricking people online into thinking he knew how the law worked. If he says something in a case, I assume he is wrong.

In contrast, look at AttorneyTom's channel. That is the model for what a practicing attorney should do: stay in your lane, and you can still have fun content.

All four of those occurrences involved Monty's emotional distress claim.

My read of the ruling is that the judge does legitimately appear inclined to dismiss the emotional distress claim at this time, unless Monty can demonstrate some evidence of damages associated with that, which TBH I don't see happening.

There is still the defamation claim and there I'm not so sure about whether Rekieta is poised to prevail on that (for the reasons @Strix454 later discusses). On the positive side for Nick, the judge appeared to agree (at the start of page 4) that both parties constitute public figures.

I am not sure that is the reading... Nick would be wise to try to clarify the public figure status to get the heightened standard of 'actual malice' put onto Quest.
