He might be, but historically Null's position, in the rare cases they do, is to tell the flier that the content is covered under fair use for the purposes of ridicule and criticism. Only in rare circumstances has he taken down content, even with a correctly formatted DMCA claim. For example, he did take down a .zip file pirated game just recently, because he recognized having it here wouldn't pass muster within fair use.

Null's post about Scott Adams cartoons is particularly relevant here.
