Burden of proof was on the state to prove anything and they were able to get past a grand jury, but could not get a conviction. So some degree of evidence likely exists (proof of sex), but during the trial phase it was probably determined that proving motive would be next to impossible and that more effort would be wasted on pursuing a conviction (retard fucked invalid mother, tax dollars must be spent now) and were happy to work with the defense who offered 'rehabilitation'.

Why waste everyone's time fighting over the indictment when you can beat the rap by playing the tard card? It saved everyone involved time.

This is why most defendants (with paid counsel or otherwise) waive the preliminary hearing in cases that don't have an indictment. Why throw money away on a hearing you will lose every time instead of saving it for stuff you might win?

As have been said Chris isn't a master mind, he has one recourse when in trouble resorting to being a child stay quite infront of those that could punish him and hope they clear up his mess for him.

I don't know why people think this guy pulled a Matlock with Chris. His insistence on evaluations for Chris over a year or more, shipping him off to JMU's forensic psychiatry unit and other doctors didn't work. The prosecution wouldn't have ordered that. In the end all Heilberg's "master lawyering" turned Chris's misdemeanor into a felony, and then just grabbing the door handle of the courthouse shouting "He's autistic! He's autistic!" isn't exactly something that took a lot of artful knowledge of complex law.
