Texas law is not only pretty broad on the right to defend your property (it is one of the few states where you can use deadly force to defend just your property even in the absence of a threat to yourself), but Texas juries are also hostile to perps invading people's property. To get a felony you'd need to get past a grand jury and Texas grand juries are fairly notorious for just saying go fuck yourself to prosecutions over perps getting shot.
