Cogent's actions probably weren't cleared with their Legal department; putting their lawyers on alert might get someone asking WTF are they doing.

The Cogent Internet Access Disclosure (A) got brought up earlier as well. This it the document that the FCC's RIFO requires all ISPs to have detailing blocking, throttling, etc. It's not one of those documents that can just say "we do whatever we want fuck you and die." No no no. These are promises that the ISP is making to its customers. See footnote 512 (BIAS stands for Broadband Internet Access Service):

Thankfully, according to Cogent themselves, "Cogent does not offer non-broadband Internet access service data services" and repeatedly calls themselves an "Internet Service Provider." I have to assume that the FCC meant non-broadband "backbone services" to mean dark fiber companies like Crown Castle (#1 owner of cell towers) that own a bunch of infrastructure and cabling but lease it out to customers who can send whatever they want through the cable.
Cogent does have the typical CYA in the footer but I am not sure how much this actually can cover their ass. Anyone have a doctorate in CYAology?

Cogent has a long standing position of liking free peering being pro-Net Neutrality and pro-Title II. And it doesn't matter anyways because Cogent took action without updating their disclosures, which according to the FCC, is a violation of FTC Section 5 "unfair or deceptive acts or practices in or affecting commerce." 1703123077390.png
The idea of this is that if someone (another ISP or an edge provider) does business with Cogent under the pretense that, I don't know, Cogent won't suddenly disconnect them from the Internet, screwing over all of their customers, just because they happen to host permit access to an over-the-top US legal drama forum:

They can sue Cogent for damages. I don't think that saying "people making fun of me on the Internet is child porn" is a valid argument. Cogent does have a separate AUP (A) but I don't think that matters because the disclosures document doesn't mention ANY AUP and the disclosures document is the legal document requested by the FCC. The AUP is like YouTube Community Guidelines which doesn't mean anything anyways because Rule 0 of AUPs is that the moderator is always right and you are always wrong. Cogent says that they only block to "comply with applicable law." Cogent might go for the defamation angle. Defamation (which you should never do because you should never lie about people) is not a crime, it is not illegal, it is a tort. If Cogent wants to say that statements that some claim to be defamatory is banned from being trafficked, then they should have put that in the disclosures!

Cogent is legally within its rights to notify all its customers about new rules going into effect that require their customers to monitor all their customers for mean comments and reply to Cogent's schizophrenic Abuse emails. But something tells me that most ISPs, who already hate Cogent, would rather deal with FCC red tape bullshit than deal with 3am calls from Cogent telling them that their Internet access will be disconnected in 2 hours if they don't forward to 10 friends within 15 minutes censor the Internet.
 
Have we considered any of the following:
  1. A completely new website and operator that hasn't been debanked and completely blackballed? (sorry Null) Just carry on with a new brand on a new forum and treat KF as an archive in-place. You could reset the clock on a lot of the fuckery that's happened the past few years

I greatly simplified our tor backend. When I use tor I get extraordinarily good connectivity now.

These posters are much better than niggers that reply to things and offer shitty surface-level observations and mediocre humor without contributing anything, such as @Creative Username.

He also might be a lurker that joined to say this, who intends to keep posting. Or maybe a throwaway? I don't know.
