when he talked very openly about the case it looked like he and his team was heavily leaning into the Trump insurrection defense of "Nick actually believes with all his heart that montagraph is actually a pedophile", I'm sure his reactions and speeches on streams didn't really help and at some point his lawyer must've told him something in the lines of "I know you do the whole free speech grifing, but if you keep opening your mouth and fucking up the case I'm going to leave", that's just my speculation.

I think this is a just a new excuse because the old ones were running thin. He has evolved lately, and he cannot pull the 'sick card' again so soon.
Nick has seethed at being called non-practicing for nearly half a year now including recently. Why wouldn't he bring up the fact that he still has a limited practice? Either this is made up, or it is something embarrassing that he doesn't want to talk about, or it's something new that popped up at 3am, which at that time of night would probably mean someone he knew got into some problems under the influence of drugs/alcohol, which would fall under the embarrassing thing.

I didn't watch much of the stream, but I did check his ad read at the end of his YouTube show.

After turning off the YouTube stream last night, Nick left Branca to hold the fort while he went to the bathroom, adding that he also had to "check" on Kayla. He came back 8 minutes later and said she had him get her a Gatorade and "take some stuff out of her room" (which is the second time he claimed to have to do that in the middle of a show in the past little while since he also claimed to be lifting boxes to the car at one point recently).

Assuming the "client call"at 3am is bullshit, my first guess would be it's something to do with her. Whether it's actually some sort of a "medical issue" as he implied last week I'm not so sure. What I would say is that I would be less surprised to see Nick's name pop up on MCRO because of divorce proceedings than his name appearing because he was actually representing a client in court as the attorney of record.

Based on his comments in December about how he's not lucky to be married because if he was he'd have a prenup and his recent comments where he says he's not sure if he would recommend marriage and seemingly has gamed out a divorce it sure seems like something is going on.

Not cynical, just someone with basic observational skills. As part of the gaming out the divorce, if you listen closely, he implies that the wife in the completely hypothetical situation will try to seek full custody to maximize the amount of child support she receives.

This sounds odd until you realize that Kayla probably actually wanted children and Nick wanted a piggy bank where he could whine to his parents about how his house was too small for all the kids and they needed another one.

He got called at three in the morning. Allegedly. That's not some sort of civil matter, since at that hour, somebody fucked up, probably under the influence of something, and it would probably be some sort of family member, friend, or some sort of acquaintance who knew him from somewhere and he was the person they knew who was a lawyer and thought of calling. Nobody is calling at 3:00am to discuss changing their will or negotiating a lease agreement.

But, whatever, it probably didn't happen. Even Rekieta's fans are starting to push back on his absurd excuses about how he has to drive his kids 36 hours a day, and he's likely trying new ones out.

As you say, he could be practicing law in terms of contracts, wills, doing stuff out of court. I don't believe for a second he is, but it is possible. Not at the dark of night.

I think people may be confusing his law license with the LLC for his firm. His bar license is up to date, which surprised me considering the CLE requirements (we know he wouldn't give a shit about spending money on it, but time and effort are another matter).

Didn’t see that but the whole month of Jan quite a lot of the rumble flip points were absurdly long with Nick mentioning that he had to “check on” Kayla, tell her goodnight, or do some mundane task for her when that never used to be the routine & she should have been asleep at that time anyway. Something is definitely brewing with them.

If he had some “client” emergency it seems like he’d not have had the time to type out a whole locals excuse & would have just made the no locals stream announcement & done the explaining later.

It's actually a defense Monty has to overcome, at least if it goes forward on an actual malice standard. It it doesn't, Nick is seriously fucked, but there's a solid chance Monty is some sort of limited purpose public figure as he has embroiled himself in numerous controversies. If it's actual malice, Monty would have to prove Nick had some subjective doubt about the truth of his statements.

Randazza will probably trot this out when/if his ludicrously speculative attempt to import Colorado law fails. I note that's not even guaranteed, and someone on this very thread has made a coherent argument that the usual lex loci (law of the place) rule applies and it is not as insane as it sounds to do that. Randazza isn't a moron. He isn't going to present flat-out frivolous arguments (unless it's really really profitable for him and he thinks he'll get away with it).
