I think everyone is talking past each other with this. Leaking the documents would imply that they put her medical records out into the public. What it sounds like they did is go into to much detail with uninvolved coworkers. This is not illegal unless you can cite me the Japanese law stating it. HIPAA or Canadian laws are not the shields people want them to be. Remember vax passports or that America I think still requires you to show proof of coof vax to get in legally even if you are a citizen, something that's kept Null out of the country for years?

The medical stuff wasn't illegal. What it was was a bullshit attempt to make themselves look better and a betrayal of trust to their talent. This is an unmistakable warning to all that if you make things slightly difficult to annoying for them they will shit on you from on high with everything they have no matter how personal.

I really, really feel terrible for Niji fans caught in the crossfire. They cannot enjoy their streamers because of the decisions of a dipshit with a boat. If their streamer was completely innocent of all the fuckery they're still tainted by it. Imagine if this happened to Prism and Pina or Sara or Non or whoever had to contractually read some corpo hit piece or else they loose everything too.
 
Just got around to listening to part of the damage control video on Elira's channel. I can sort of see the angle the company is trying to make that Selen was essentially insubordinate. This seems to be something quite common among all these people here or in Hololive, but I don't see why they felt they couldn't let it slide especially after the claimed suicide attempt.
she paid out of pocket for years because of nothing other than goodwill because her company shafted artists they contracted time and time again. Her resentment obviously built up and reached a breaking point. The company had been mismanaging business for years. They sent NDAs to these artists multiple times too late and with the wrong names on them. They're a total fuck up as a business and Doki was right to be angry at them.

TBF, EA has the size that Niji has to come to them rather than the other way around, so they can afford to remain on good terms with Doki while not getting cut off from her former employer.

Again, this is part of the definition of leaking medical records. Health information in Canada goes by the minimum necessary standard similar to the US. This behaivour is not okay. Let alone the fact that it was tied to confidential legal proceedings, which have their own entire ballgame of privacy rights.

Canadian contractor to a Japanese company. She didn't revoke her citizenship and still lives in Canada. It doesn't matter if she can take action in Japan or not, she can take action in Canada. Now the problem here is actually getting Niji into a Canadian courtroom or getting them to respect the results from one. But that's for international treatise and business politicking to decide.

Vax passports can't be held to the same standard as anything else. All sorts of rules were broken so they could slam that boot on our necks.

I'd bet that AnyColor has some sort of official business/legal registration in Canada in order for them to hire their Canadian talent, so they are probably beholden to Canadian law because the situation concerns a Canadian citizen and the Canadian branch/entity of AnyColor that hired Doki. You can't do business however you like in foreign countries, you're still required to follow their laws even if you're headquartered in a country where sharing legal and medical documents with outside parties is somehow okay

not meant as a defense, EA is retarded/greedy most of the time, but for the record on rare occasions they can be pretty based. for example look how they handled the c&c renegade remake, other companies are way bigger cunts when it comes to that.

Correct me if I'm wrong, but is doctor-patient confidentiality is even relevant to this case? This isn't a matter of a doctor illegally sharing Selen's info. This is a matter of one lawyer sharing Selen's info with another lawyer with some kind of NDA attached, and that lawyer then disclosing a small part of that info in some form to the rest of the talents. We don't know what that NDA looks like, we don't know if its enforceable, we don't know what it specifically asked for, and we don't know exactly how or what the talents were told about the information.
