I've seen someone argue that Nick is lying about the 3k snack bill, that it would be impossible to spend that much per month on snacks alone. This guy can't fake anything -- Elaine Benes, he is not. Nick would be the first person to let everyone know how sick he is, while also tooting his own horn for how honorable and amazing he is for streaming through the pain anyway.
 
And my less than zero information opinion is employment discrimination is ludicrously difficult to prove. America is mostly a hire and fire at will country. Plus the other side is Disney, with more money than God. That said, she seems to have gotten a raw deal, and the question is whether it was an illegal raw deal, or whether this is just yet another thing where Disney gets away with everything.

Maybe the days of that are over.
Cash on hand, Elon probably edges out Disney at the moment, though that is more questionable now after the Delaware Court's BS over his compensation contract with Tesla.

However, Disney has been cash strapped for awhile now. The Hulu forced buy from Comcast took out almost all of their surplus. They had to up prices again at the parks, as that is their main piggy bank. They are probably as weak as they have been in 30 years. So who knows whom has the advantage when it comes to lawfare?

As for merits, it is a novel theory. They are suing in federal court, but under California labor law. And that law was changed a few years back to essentially eliminate for-hire work. Contract workers are now considered full time employees when it comes to EEOC and benefits complaints. They made those changes to be able to unionize Uber and Lyft. But they had to word it more broadly to apply to all industries. California is also the most closed shop state, other than possibly Illinois, Massachusetts and Wyoming (yes, Wyoming is an extremely pro-union state.)

All-in-alll, if there was ever a chance for a high profile fisking of Disney, this is probably it.

Yeah I have to admit I didn't believe this. Sorry for doubting you. I went and verified myself that he in fact made $0.00 over the course of over an hour on YouTube.

I also saw that his chat was revolting and demanding he cover the actual news. Nick says he will try to cover it tonight or if not on a makeup stream or something during the day (this came out as if second nature, he was trying not to say it because it never happens).

He did make $41 on Rumble across 12 Rumble Rants in 2.9 hours. That is well under the threshold level of a Ralph wage quit.

It's also a $3.42 average per chat. Remember when you needed to pay $20 just to get the guy to read it? :story:

I am not sure what the purpose of in depth coverage of yesterday's news is, but whatever. This is like doing three shows in a row on Vince McMahon after the story dropped out of the headlines.

Bruise was my first thought too, as it heals it turns yellow a lot of times, but I didn't see any early indication of the blue or purple from a bruising. One day it just turned yellow on stream. Unless he was caking on makeup or something to hide it.

It's a federal case based on diversity jurisdiction, so state substantive law applies while federal procedural law applies under what is called the Erie doctrine. It isn't unusual for federal courts to apply state law. I'm not sure about this specific state law though.

There's also a specific issue that it's about acting. Acting is not subject to a lot of the same rules as normal employment. You can refuse to hire someone who is too fat to be an action hero, or not hire someone to be Othello if they aren't black. The contract employment law in question may not do away with this general doctrine, and indeed legislative intent appears to have been aimed at "gig economy" jobs like Uber and Lyft. Bespoke contract work is a different affair than normal employment. For instance, nobody can tell you you aren't allowed to insist on hiring only a Jewish lawyer, or a doctor of your own race, or only specifically hire Taylor Swift for a concert.

California also has a law, unlike many other states, specifically prohibiting politically based employment discrimination. In most states you can literally just fire someone for being a Democrat, or a Trump supporter, or whatever.

I'm looking at the stream lengths and it makes no sense. Nine hours over three streams just to read the complaint for the Vince McMahon lawsuit? How the fuck does he manage that?

It would be one thing if he was going through deep lore or pulling up case law, but I'm gonna guess he isn't. The most he does if he really cares about something is pull up a statute and make guesses about how it's applied which is one thing that Legal Mindset correctly called him out for.
