He literally took a swing at a cop without even taking a nightstick to the face in response. They were entirely correct to treat him as an unstable lunatic at every encounter.

"As I said, at about 11:30 at night or so, two Milwaukee police department officers showed up on my porch. My wife and I had been binge watching something and going through some bourbon because it was lock down and there isn’t a helluva lot else was there to do on a Thursday night?

And so I answered the door with a buzz going not really expecting the police, not really knowing what to expect at all, to find two hot head idiot officers with their hands on their guns, shouting in my face, demanding to know where the children are. Where are the bodies? What have you done? And I’m like who the fuck are you, what the fuck are you talking about? Come back with a warrant.

And the confrontation escalated to the point that my wife had to step in and go “Ok, you testosterone soaked idiots aren’t listening to each other. We are being stalked. This is a fake report. And she led them away and had a more deescalated conversation with them. Because I was about to fucking punch somebody in the throat. You don’t just show up to my door and accuse me of killing children. Like what the fuck. I don’t care if you’ve got a gun on you or not."

So in this account, which is almost certainly *heavily sanitized* to make him look better given how much he has lied and tried to sanitize other inconvenient incidents in his life, Fatrick admits being overtly intoxicated and confrontational right off the bat and within a minute or two was actively wishing to take a swing at one of the officers even if they had guns drawn on him, meaning that even with maximum spin his account makes him out to be

a) a drunk​
b) violent​
c) an idiot​
d) fat​
Furthermore his implicit hostility and contempt for the police is readily apparent (as is his implicit homosexuality and the implicit ponderous swing of his bitchtits) which makes me think they said something that made him see red, and being bereft of what infinitesimal inhibitions due to the half shot of Makers Mark he just drank while watching Lena Dunham on netflix he went absolutely fucking apeshit at them, causing them to unholster and loudly and directly tell him to shut that shit down immidiately before nikki tard wrangled him out of sight before he tried to charge them

Pat uses that fractured quote (notably the last part is not in quotes) to imply that the officer knew that the call was bullshit, as opposed to the officer knowing that there are many reports/calls issued on Pat.

torswats was not the first and won't be the last person to weaponize calling the police. This is broader than pat. If the police can search your house sans warrant based on nothing but an anonymous call, particularly after multiple known fake calls of the same type, it's no longer a pat problem- it's a Constitutional concern. What does the 4th Amendment mean if the government can ignore it by saying "well, we received an anonymous spoofed call that we should have known was fake?"I also have no reason to believe that milwaukee PD did anything to help find torswats but that may remain to be seen.
I'd counter this with two things.
1): What "way to deal with this issue" would you propose for a man who is convicted of sending threats of premeditated murder to a previous spouse, and has a history on record from previous incidents of being aggressive and violent with interactions? "Yeah, don't go to his place, no matter what the call says" isn't a viable option
Cops deal with people much worse than pat all the time, he's not special in this regard and still has 4th Amendment rights. I also wouldn't expect them to say "don't go to this place no matter what" but there are many ways to investigate these calls and we know that because more competent jurisdictions have done just that, though it's rarely publicized.
Everyone from Nick Reikeita to MTG has had these calls. You can start by establishing a note in the call history for the residence that it is a known victim of swatting and add a phone number to call before even going there. I suspect they did this eventually, because the swatter adopted the strategy of not using the specific address so the alert wouldn't pop up. After that, you include it in roll call briefings. It sounds the police may have eventually adopted at least some of these ideas; without some actual fact-finding (a trial) I don't know when and how many damages would have accrued before they wised up. Or if he's lying about large parts of it, which would also be funny.

Nah. It is well established in caselaw that the police are not legally liable for an individual's protection absent a 'special relationship' (which this would not be). You could be getting stabbed a few feet away from cops who hide instead of helping and you can't sue em. Legally, inaction is a lot safer than action in most cases.
Hell, even in the altercations which are escalated, they're treating him with absolute kid gloves compared to if it were anyone else charging an officer and attempting to throw a punch, limp wristed and effeminate as it may be.
Devil's advocate position would be that they knew they had escalated that situation beyond where it should have been and that's why they didn't book him.
They didn't do that though. Short of the one incident where he was acting like an insane autistic ape and they correctly responded, most of these have been simple wellness checks or even just a phone call. Fatty is lying.
If that's true I look forward to the perjury saga. It sure would be stupid to do so in an age of body cameras but I'm not putting it past him.

I also think people here tend to be pretty biased against him for understandable reasons. Including because he's fat.

True. I suppose we would have to see the video. If there is one. In order to get the context.

That said though, if we take what Pat is saying on face value, this exchange happened after this particular officer has arrived on his doorstep multiple times for bullshit. This would I suppose depend on the timeline of events. The complaint seems to imply when Evans said he "was aware" of the situation, this was not the first time he had been called out to a swatting at the Tomlinson house. I would argue this broad interpretation of what he meant by being "aware" could be favorable to the State if this was the First time he was called out. The complaint is not entirely clear on this point.

If this was a second or even third time however, this could be more of a problem for the defense. Because being "Aware" in the context of "The Situation" could be seen by the fact finder as meaning he was aware that this was another Swatting, but he was going to use exigent circumstances anyway. I'm going to blame the shitty writing of Pats lawyers for this one again. Because something like this is something that you absolutely must be clear about. Did Evans say "he was aware" the FIRST time, or the SECOND time? Because the two present a very different issue.

Future law students, this is why your legal writing professor autistically scolds you for bad commas.
