That's not what he said, though. If we take it that Pat's not lying then he said that he "was well aware of the situation" which can mean many things. Pat uses that fractured quote (notably the last part is not in quotes) to imply that the officer knew that the call was bullshit, as opposed to the officer knowing that there are many reports/calls issued on Pat.
I suspect that what we have here is a standard "some asshole gives a story" and the cop is saying "look, faggot, even if your story is true, we still have to fuck you in the ass" - this is standard cop stuff. Even if your stalker child story is true, we have a probable cause call and we need to clear it.

The fact that he waited until now to do this shit lends quite a bit of credence to this all being planned, first build up some media shit over it, then do the lawsuit.

That's actually the rule for dismissal under 12(b)(6) if the state defendants opt for that. The factual claims of the plaintiff, no matter how nonsensical they are, are assumed to be true. It's conceivable that Fatty has lied so much he gets over the threshold of a qualified immunity defense.

I suppose that is what lawsuits are for in the perfect world. To ascertain the truth. Pat could be full of shit, but on the face of his complaint he has a case. Even if Russell Greer is a better legal writer then the three lawyers who wrote this thing like it was some sort of pro forma class exercise in civil torts.

That's why it might conceivably get past the qualified immunity defense into discovery, because Pat has lied enough to create a triable issue of fact (generally at the dismissal stage they do not question the factual allegations no matter how ridiculous they are).

In that event, things get fun.
