I'm a long time gamer from one of these places you mentioned. And I bought a lot of these games (God of War 2, Spiderman 2 and Alan Wake 2) without much research because:

A) I work insane hours, don't have the energy to micromanage every small decision anymore

C) I had never heard of SBInc.

More importantly they don't need precedent; the law is very clear that piracy is not legal and circumventing or facilitating circumventing the DMCA is not legal. They turn a blind eye to most of it, only really doing anything when it gets egregious or at a mass scale.
